  • BTW POPLA said they wouldn't discuss it on the phone and I must submit my mitigating circumstances as to why the appeal is late online, so I just submitted my reasons with my appeal at the same time making the reasons very clear in the first few lines as recommended here...

    Oh crap

I didn't include points 2, 3, 4 and 5!! I thought that was it. I submitted the appeal before you had replied Coupon-mad as I knew time was ticking....

Crap! Do I just go to the POPLA site now and add points 2 3 4 and5 as 'evidence to submit' as you can submit evidence after you have submitted an appeal...

Also Excel parking have now sent me a 'LIABILITY Notice' giving me 7 days to pay the £100 .

    Please advise!

    Thanks!

Yes just email POPLA again and say you accidentally missed off your other points. Luckily for you, POPLA let people email more info!

  • Done! Thanks so much!

What do I do about this 'Liability notice' for £100, if POPLA reject my appeal what happens next. I really don't want to end up affecting my credit score/ end up in court

Ultimately, I did pay £1 to park in Iceland but I can't prove it, do I really have a case?

    thanks!!

Jeez, this really has put the wind up you. You are worrying about a CCJ when it's clear you don't know how it all works. This is a standard response I post for those similarly intimidated.

And all this is only if:

    A. You lose at POPLA (our appeals don't lose, but you are perilously close to having missed the deadline, handing a default win to the PPC).
    B. You choose not to pay the charge (POPLA not binding on you, only the PPC).
    C. The PPC/debt collectors chase you for months and you still don't pay.
    D. The PPC decides to issue court papers. Then -

    1. You go to court
    2. You lose your case
    3. The Judge awards costs against you
    4. You have 28 days to pay up
    5. You fail/forget/refuse to pay the costs awarded against you
    6. You receive CCJ
    7. Credit rating qualified
    8. Potential problems getting credit in future.

A few long steps before the hangman pulls the lever.

But all of this is within your control.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • POPLA have rejected my appeal as it was late they said. I am not sure if they even considered my reasons for late submission, seems like a standard letter....

Can someone please advise what I do now?

    Thanks

nothing you can do unless you get the owner to cancel it

you were warned enough times to read and follow the NEWBIES thread, you didnt, , you also failed to meet the popla 28 day deadline too, so unless the landowner cancels it you will get debt collector letters for 6 years, possibly court too, as Excel do take people to court

perhaps in future you will get a shift on and get the appeals in on time or even follow the advice given from here in good time
  • Whilst i don't expect any sympathy from people here, I really have had a lot happening and had to travel abroad for family emergency reasons.

So basically I have to pay or debt collector letters and court?
  • Can someone plz advise

    Thanks
