  • @barrowvian - EE's defences to date have generally attempted to divert the adjudicators attention away from the case and bring up irrelevant comments.

    for example in relation to the price rise case they stated - The Respondent submits that the cause of action pleaded by the Claimant is neither directly related to bills or communication services and therefore represents a dispute which falls outside the remit of Rule 2(g) and therefore is a matter which is not within the jurisdiction of the Scheme.

    they are more interested in getting the adjudicator to dismiss the case from the off than actually defending their actions and our cases, so hopefully if it goes straight through to an adjudicator we may have a slightly stronger position, although that would mean we don't get to see EEs defence to draft something for others wanting to claim.

    ULAGGY; completely unrelated to the topic, but I'd taken two companies to the SCC before. I've won both claims and both were settled before it even got to Court. I'm assuming all the costs really add up for the companies when you go via this route. If you're claim totals less than £300 (iirc) then the court fee is only £25, and you get this back if you win.

    Yeah, I'm certainly tempted just to forget trying to argue with CISAS (who knowing my luck would only rule in T-Mob's favour a second time) and just go straight to SCC!
  • Still nothing from EE or a response from my call to CISAS this morning... has anyone else received a defence yet, I seem to remember several people were due response back yesterday and today.

  • Still nothing here either. I've tried to use the end of business today to push for an adjudicator before EE try and sneak something in late.

    As I haven't heard anything today I'm assuming EE haven't bothered to submit a defense to my T&Cs claim against them? I can only hope that this again highlights EEs poor customer service that they haven't even bothered to take the claim seriously.

    Providing EE haven't supplied a defense on or before the end of business today, 04/09/2014, which happens to be their deadline, as well as not providing an adequate reason for an extension due to exceptional circumstances, please could I request that this case be forwarded immediately to an adjudicator for a decision.

  • Hi all as an update spoke to CISAS today apparently EE have raised an objection to the claim and therefore it has gone straight to the lead adjudicator to confirm whether there is a case or not.

    Whilst not neccasrily good news I should have an update from CISAS tomorrow.

    Good luck all! CISAS do seem to begrudge supporting the customer, even despite the positive rulings - If we need an extension we have no chance, if EE/T-Mob/Orange need one, they'll bend over backwards!

    I honestly expect all of you will get emails from CISAS saying that an extension was granted.

  • Once been told go to cisas this is my 2nd appeal. Do I e-mail cisas? As EE provided me with there e-mail. Unsure on next step any help much appreciated thanks. Also I am getting 40% family and friends discount but want out the signal is rubbish and cost up from 21.60 to 22.18.
