So even though I got him through them.. they promoted him etc they arent at fault in any way even tho they admitted that they were but they just dont want to part with any cash..

If this is the way he charges everybody, then you won't be the only one. Therefore, you need to make a claim to his estate (write to his address with your "bill"). They will have his diaries and can tot up to see that what you say you've had matches his diary - and if everybody has 4 lessons held over for the test week then that too will be "the way he does it" and known to his family etc and there will be about 20+ other students also asking for the "4 + remainder".
So, your best course of action is to write out a bill and a letter with your "claim" on it. This will then go into the pile of bills outstanding and when his estate is distributed to creditors/heirs you'd get your money back (unless he died broke).0 -

Maybe .... e.g. would eBay be at fault if a seller died before something you bought had been sent to you? Maybe they're just a service he uses to take calls/promote his service.0 -
You paid your money to the instructor, not the Driving School, you employed him, the Driving School did not.
Even if they were at fault for not checking/insisting he had public liability insurance, this does not make them responsible for any losses you incurred because your instructor could not provide the lessons you paid him for. And it is most certainly not their fault that you failed to obtain a receipt for a cash payment.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -

but i had to pay my first lot of money to the driving school, thats the part I dont get.. If it was all between just me and him then why did I have to pay them first. I get what you are saying and im not saying you are wrong i'm just saying im not 100% clear about how theyve gone about their business. Admitting its their fault then saying its nothing to do with them.. this is what I am unclear about. Why admit to being liable for something then totally go back on that.0

Look. Go and see the CAB or whatever. You wont be convinced by anyone's view here.

All they did was say he didn't have insurance.
That is your instructor's fault.
