    Ive spoken to them and written a letter.. they're adamant they are not at fault in any way

    My view.
    Leave the widow alone. If you wish to make a claim on the instructors estate,then do so.
    Otherwise leave her out of this. This is a relatively small sum vs her loss.
    If the instructor was self employed,then I doubt you will have much claim.
    fr them to provide 9 lessons,they would have to pay another self employed instructor to provide them.

    What is the financial relationship between the driving school and instructor? I'm just wondering if the instructor pays a portion of each lesson to the school, although I guess he may have died before he reported it?

    I guess it isn't that simple though.

    Do also remember though when you are dealing with these people that they are probably quite upset about the chap dying (which I assume was unexpected). You should persist in trying to get your money back but do it in writing. I would send the same letter to the driving school and the widow, by recorded delivery (and keep the details) and then give them time to respond.

    She didn't pay the money to the driving school and she has no proof of payment. I can't see a judge finding in her favour.

    In fairness I think the driving school are more upset about their mistakes. They were talking about him like he was a con man and stuff. Its horrible because I really got on with my instructor and I was trying to be reasonable but they got their back up straight away and started accusing me of lying. I understand that I dont have a receipt and i should of got one but I did genuinely think that my instructor was keeping a record of my lessons and that everything was proper and legit. After speaking to friends they told me that their instructors also gave them a book of their progress etc and I had none if that. The Driving School manager I spoke to was so unprofessional. Im just annoyed that I put my trust in them.

    I assumed that because they assigned me to him that even tho he is supposedly self employed he must be paying them something so therefore are they not at fault if hes not keeping proper records etc.. ?

    Why should the driving school be at fault? The instructor is self employed, he is not their employee.

    Because they admitted that he wasnt legit, or properly insured and as a Driving School they must of been making money from him somehow otherwise why would they ov put me in contact with him. He isnt some guy I found in the paper. I went through a Driving school so I wouldnt end up with some cowboy trying to make a quick buck. The Driving school vouched for him so they should be at fault should they not..

    Oh, I read your earlier comments as telling us that he wasn't properly insured... not attaching any blame on the school for that.

    The fact that he wasn't 'properly insured' does not mean that the Driving School has done anything wrong.

    It is up to the self employed sole trader, i.e. your instructor, how he runs his business.
