Driving Instructor Died.!!

    Basically

    Bought 10 lessons (received 6 and 4 are held back for the week of test)
    First lesson was 10/01/14
    Had 6 lessons
    Paid £190 on 20/02/14 for 10 lessons
    Had 10 lessons
    Paid £190 on 24/04/14 for 10 lessons
    Had 1 lesson on 01/05/14
    Instructor died on 08/05/14 which would of been second lesson

    Your problem will be that you will have to prove to the executor of the estate that you paid for lessons which you did not receive.

    Having personally been an executor, I would never have paid a debt without proof of it being incurred.

    Pay for future lessons? That suggests you paid one way initially and was told that subsequent went direct to the instructor but you only mention having paid for having 10 lessons and that payment went direct?

    What is the name of the school and what area are they in?

    I'm no expert, but if the company has admitted that the instructor should have been insured (and presumably they had an opportunity to check this), and are not disputing that you paid the money, perhaps the best solution would be that they offer you the nine remaining lessons with another of their affiliated instructors, at their cost? Presumably you approached them because they were a reputable company and you would expect them to ensure that the people working for them had the right insurance in place, and followed the correct practices for receipts etc. The practice of not providing a receipt for that amount of money seems pretty dodgy to me. I also don't think it's reasonable to expect you to have to sue the guy's estate for what is a relatively trivial amount of money. Personally I would be fairly assertive in asking for a remedy. You could mention that you have friends who will be booking driving lessons soon and you would like to be able to give a positive recommendation for their company.

    My boyfriend paid for my initial lessons through his card as a xmas present.
    I paid my instructor for two blocks of lessons
    Based in Blantyre

    Could not the estate be sued and judgement given on the balance of probabilities?

    They are basically calling me a liar.. saying that im making it up. The manager was quite abrupt and started getting aggressive when i asked him that if he is admitting my instructor wasnt insured then surely he was at fault.

    I have spoken to his widow and she said there is no estate but said that he is employed by them so they should refund me.

    Its all such a mess.

    In that case, i would probably do a letter before action to the driving school and take it from there. i would also delete the name of the firm as a google search might bring them here!
