I would save the PCM issues for the appeal process, stick with calling out the council over the demarcation between public roads and private ones, lack of signage etc , lack of a clear distinction between the two , and if they are complicit in handing over public road enforcement to private companies etc

I suppose it all depends who actually owns the road the vehicle as parked on, the council ? or not , if not where does the public road actually end and a private one start ? how is a motorist supposed to know ?

you keep asking all these questions about councillors and councils etc, how are we supposed to know ?

that is the purpose of your letters, to glean the information out of them, by involving as many people as possible, so my advice ? , if in doubt, send it anyway, to whomever you deem should get the letters - if you dont ask, you dont get !

I went back to the scene of the "offence" last night to take some more photo's of the area and signage, and generally just take a look around to see if I could gather any evidence against PCM. I took a pic of how far away the signage is from the entrance of the road where the private land supposedly begins. I then paced out how far the sign was from the entrance - it was roughly 23 yards/strides!!! Surely that must give me some clout when appealing? Is there a "legal" requirement that the signage must be at the entrance of the road? Or within a certain distance of the entrance? I mean, there must be a cut off point?! How far up the road would be deemed far enough to warrant the invoice invalid due to poor/lack of signage?

I also had a closer look at the sign, then had a look at the back out of it, and it had there old Clamping Signs from about 2 or 3 years back, I recognised it immediately because the council used PCM to "control" the parking in the Close where I lived in 2011. They tried to reduce the parking in the close by half, which made it a nightmare for Residents! So on the first morning (about 6.30am), about 10 residents cars were clamped for parking where they were no longer allowed too. Some residents had 2 cars clamped and it was costing them hundreds and hundreds of pounds to get them unclamped! Later on that day, I overheard one of the PCM jobsworth's speaking to his depot, cheerfully explaining "we've got about 14 so far!!" Which would've had easily equated to somewhere in the region of around £3k!!!

Anyway, several emails to the council and a huge petition later, the scheme was removed after one week and the Residents who had forked out to have there cars unclamped were (i believe) reimbursed.

ok, IAS (in your case) , or POPLA or in court in front of a judge

you are concentrating one one case, we are giving out advice on hundreds of cases where very few are the IAS

IF and when you get a rejection of your NTK appeal you will have 21 DAYS TO APPEAL to the IAS and judging by recent posts on here its going to have to be a damn good one, or let parkingticketappeals do it for you , just to be sure

my actual point is that these are the questions you bring up with the council , the councillors , and check the IAS code of practice (in your case)

yet you keep asking us, plus you expect all replies to be fully conversant with your case

if you are paying a solicitor or parkingticketappeals to help with your case then fair enough , they should know your case, but if you expect people to give up their free time helping hundreds of people on here then you can expect a few errors to creep in , but that doesnt detract from my point of it being in your appeal to the arbitrator

I could ask that you make this a 2 way street and help others as I dont see any evidence of this happening at the moment, not even with IAS appeals , never mind the more popular POPLA appeals

I wont bother replying any further as I have no wish to keep reading a dozen pages just to give free guidance to one person

Wow Red. It was a light hearted joke that was mainly aimed at me for getting so many previous things wrong! I sincerely apologise if I caused any offence. Non was certainly intended. You have no idea how much I value all your help, comments and feedback.

I also apologise if you think I don't get involved or chip in on other threads/appeals etc... this is all still new to me as you are aware and my advice (for want of a better word) would be more of a hindrance than help!

I am doing a lot of groundwork by pressuring the council/councillors as much as possible and I am still "swatting up" as best I can in preparation for my inevitable appeals process.

I apologise if you think I'm demanding in my posts, I don't believe I have been. I just like to get expert advice on whether I am doing the right things so far. I am, by nature "a worrier", but I'm trying to keep a calm head, even though I know I will have a battle on my hands with IPC/IAS.

So all I can say now to you is "sorry" - and I will not post any more now until we receive the NTK and then hopefully get some advice with our appeal.

Bazza we appreciate you are a newbie, but you are on post 119 and you haven't even received your NTK yet. Most threads from start to finish are usually no more than 30 ish posts even in difficult cases.

We know you will need support when it goes to IAS but you will lose us with the endless questioning. People have been patient so far, but as Redx says there are a lot of people to help and you are (sorry for saying this) being very high maintenance.

So wait for Ntk, put in first appeal then if it gets rejected, come back so we can help plan an attack for IAS. In the meanwhile continue to gather any evidence you can. So photo of back of sign with clamping, if it is readable from road, then this is good evidence.

Sorry for being blunt, but you will get more help of you ease off a bit. We don't want to see you fail, but we don't want to see others fail either.
