Disabled bay with badge fine, and lied to.

Options
Long story, bear with my ramblings please...staying overnight at Premier Inn, pull into the disabled space right outside their entrance, display blue badge, member of staff comes and takes my bag out the car for me and checks me in...no mention of where I'm parked. About an hour later go out and have a parking ticket, from Europ company, as apparently said parking is for magnet kitchens, opposite the prem inn, only. I go into Prem ?Inn for help, and asking why they didn't tell me this when I parked initially, they say it's down to ?Magnet. I go there, getting more anxious and upset, I do have mental health probs and this was not the best start to my trip, and they say thus happens often with Prem Inn and, as I'm staying with them, they should help me. By now the duty manager, a Tony soprano wannabe, has pitched up and said that I was told by the member of staff who took my bags out, me"no I wasn't, else I would have moved it"him" I trust my staff" and said member of staff, so helpful and polite has now done a total Jekyll send Hyde on me. Apparently, they called the number on the ticket, left a voicemail as it was Saturday and, as I have now left the hotel " assure" me they will contact me if/ when the company answer their call. So what do I do in the meantime...if I don't pay in 14 days the fine shoots up, they contact DVLA etc. I was slope and vulnerable at the Prem Inn as the bully boy duty manager realised, I will be reporting him and the lying member of staff to their head office tomorrow morning, FWIW, but I still have this fine hanging over me and, TBH, I don't need any extra stress and worry at the mo.

It's not a fine and you will not be paying.

Wait for the notice in the post and in the meantime read the sticky at the top of the page.

Complain to the Head Office tomorrow but AVOID use of the word 'liar' and 'lying'. Do NOT phone them up to complain or you will rant and it will defeat the object. Contact them by email or letter with a well-worded complaint about this. Tell them the outcome you are seeking is a cancellation of the 'PCN' (you have looked online and realise it's a fake ticket but it's still one that has to be appealed to get the firm off your back). Tell them how this has made you anxious and upset. Tell them that as well as being a vulnerable lone traveller, a Blue Badge Holder, you also have mental health problems and this was not the best start to the trip at all and it has put you off using Premier Inns again.

As regards the appeal, as long as you are the car owner, do NOT appeal to the PPC yet. The NEWBIES thread (the sticky thread stuck at the top of page one of this parking board) tells you why you should WAIT to appeal, and explains the acronyms for you.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What notice? From the DVLA. Else how will they know who I am?

You wait for the Notice to Keeper, as the NEWBIES thread tells you. Please read it first, that's why it's at the top!

So can Prem Inn get it cancelled?
Yes - if they are the client who have the contract with Euro (Euro Car Parks?). Or they could probably liaise with Magnet if THEY contracted Euro.

Prem Inn and " they keep doing this"

Hence why you write a CALM BUT ASSERTIVE letter or email to the top banana at Premier Inn and tell them how upset you are and what you need them to do about it.

Please, please read the NEWBIES thread before you go to sleep, it will set your mind at rest that these fake PCNs can be appealed and won EVERY time anyway, if you just wait for the Notice to Keeper next month.

You really need to follow Coupon-Mad's advice, she is very good at this.
I know it can seem scary when you struggle to cope with things like this, but if you take a deep breath, be patient and don't panic, it will be ok. I know we are a bunch of strangers to you, but people in this forum really do know what they are doing.

Just to check though, is the car yours or your dad's as the notice to keeper will go to the person who actually owns the car.

    So to repeat the process:
Send a strongly worded complaint to Premier Inn Head office in clear terms outlining the issue and tell them you want them to cancel ticket
Wait for the Notice to Keeper to arrive through the post. Do not respond to the windscreen ticket
Read the Newbie thread every day till you get the ticket, posts 1-3 only at this stage until you begin to understand the terms and process you will have to follow.
When you get NTK, then send off first appeal based on what C-M has written in Newbie thread. If it is rejected and Premier Inn have not cancelled, then you will need to do a second appeal.
We will help you write this as you have extra points regarding your health that need to be covered.

It will be alright. Failing that we can provide you with details of an appeal company that will do all this for you for £16 if you wish. You will pay nothing more than that.
Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

Do not panic. You are in good hands here and you will not have to pay anything. It can be daunting at first but the experts here like Coupon-mad and Aaron Ardvark are well versed in this type of complaint where people who are protected by the Equality Act 2010 are victimised by private parking companies.

Do not contact the parking company yet. Research the Sticky thread for Newbies at the top if the page until you receive a Notice to Keeper (NTK) through the post. Do not respond to the windscreen ticket.
In any correspondance, do not name the driver. Appeal as the keeper using words like, the driver did this, the driver was told that etcetera.

In answer to your first question, the PPC will eventually send you a Notice to Keeper. They have to pay the DVLA for the privilige to get the keeper details from your car registration number. This will be from a private company pretending to have some authority, not the DVLA.

In answer to your second question, Premier Inn should be able to get this cancelled, but it is irrelevant. You will have to pay nothing. You have not been issued a fine. It will not say the word fine on the parking ticket, more likely it will say parking charge notice.

Complain direct to the manager of the Premier Inn where you stayed and Customer Services demanding they cancel the parking charge notice. State that they, (Premier Inn) are in breach of the Equality Act 2010 if they do not get this charge cancelled immediately.

You can also complain to the BPA that their member, Europ company? has issued a ticket in breach of their code of conduct which quite clearly states that Blue Badge holders must not be ticketed.

Please let us know what the windscreen ticket actually says and the name of the company. The experts here will guide you and you will have to pay nothing yet cost the vermin infesting the car park money to lose when you appeal.
