    a) I cut & pasted my message earlier. Whether you think it is dodgey iyo is up to you; it wasn't.
I think it is dodgy too. I can't think of any other logical reason as to why you are being so stubborn and ridiculous.

    b) (i) I have asked the seller a question, nothing more, (ii) I've subsequently found that their postage amount may be questionable.
Nothing more. Exactly. You've done NOTHING when you are contractually obliged to pay for the item you bid on.

    c) Campdave suggested I phone the seller, and I thanked him for the suggestion. Don't be ridiculous about harrassment.
If seller hasn't responded to message and has filed a claim against you, why on earth are you under the delusion that contacting them by telephone will make the situation any better?

I agree that there seem to be some people here who just won't give up - kind of spooky, isn't it?
Pretty sure this was directed at you

Honestly, you must just be a troll if you can't understand the simple premise that by bidding you formed a legally binding contract to pay for the item. The seller is under no obligation to reply to messages, converse or renegotiate with you, and by filing a claim has made their feelings on the matter more than clear.

Ebay won't care what you are waiting for. When the case is closed, you won't have paid and you will get a strike.
I'm not sure that ebay agree with you...

Welcome to eBay Live Help, my name is ebayrep. How may I help you today?

    Hi!

    prowla 12:34:44
I am requesting further assistance in association with my purchase nnnnnn.

    ebayrep 12:34:52
    Hello, prowla.

    prowla 12:34:54
I wish to contact the seller but I can't.

    ebayrep 12:34:58
    Good Afternoon.

    prowla 12:35:24
There is an automated unpaid item dispute opened, but I want to contact the seller.

    prowla 12:35:28
    Good afternoon.

    ebayrep 12:36:13
Just to clarify, your seller hasn't responded to regarding the item you purchased?

    prowla 12:36:26
    Correct.

    ebayrep 12:37:07
I am sorry to hear that and I appreciate the chance to assist you on this.

    prowla 12:37:17
    Thanks.

    prowla 12:37:34
There has been an automated unpaid item case raise.

    prowla 12:37:44
I have messaged the seller three times.

    prowla 12:38:16
I then requested their contact details and phoned the number, but I got a recorded message saying they no longer use that number.

    prowla 12:38:25
I apparently have no means of contacting them.

    ebayrep 12:38:26
    Alright.

    prowla 12:38:48
I have not yet paid for the item, as I with to contact them.

    ebayrep 12:38:52
First of all, since your seller didn't respond to you, even though you won the auction, this is a breach of our Seller Non-Performance policy. Just as you are obliged to pay for an item you win, the seller is obliged to sell it to you.

    ebayrep 12:39:02
In view of this matter, I've reviewed the seller's account and taken the appropriate action. It's important to bear in mind that not all of the actions that we can take are visible to you or may not be visible immediately. However, let me assure you again that I've taken the necessary action.

    ebayrep 12:39:08
Breaches of eBay's policies can lead to consequences that range from issuing the seller an informational alert, a temporary suspension, an indefinite suspension or terminating the member's account.

    ebayrep 12:40:24
If you haven't already done yet, I recommend that you leave feedback that reflects your experience with this transaction. Your feedback comment and rating will help other members who are considering buying from this seller.

    prowla 12:40:27
Thanks - I really just want the item, but I would like to contact the seller and see whether I can collect it, as I am practically driving past their door, so postage would be less convenient and a waste of money.

    prowla 12:40:47
The dispute at the moment is not yet closed.

    ebayrep 12:41:05
Okay, since your seller contact details is incorrect, I'll be sending them a notification to update their details.

    prowla 12:41:23
    Thank you.

    ebayrep 12:41:36
With regards to the case, once it is closed, you can contact us back so we can remove the unpaid record on yoru account.

    prowla 12:41:46
    Thanks very much!

    ebayrep 12:42:04

Have you been reading this thread, or just using it as an excuse to vent?

I am perfectly happy to pay for the item, but not necessarily the 3rd party shipping.

It appears that the seller may not be reading their messages and that the unpaid item claim is an automated system which they (based on their average of 1 transaction a year, one sale every two years) may not have appreciated the implications of, and thus it is not a response to my message and so their response is far from clear.

As I've said before, if they respond with "no, sorry, that is inconvenient/whatever", then I will be able to proceed. Until then, I am not giving my money to a ghost who doesn't respond to messages and gives a phone number which is out of use.

Absolutely for sure the seller should respond to messages; you can vent and rant as you like, but that is my position.

    Different in your mind only.
    Your post is extremely specific:

The line in bold can only be taken one way. It makes no mention of asking the seller about collection, simply a blunt statement that if the auction didn't state collection then in your opinion it is not allowed.

Did the auction that you bid on and won offer collection as an option?
    No.
Therefore by your own words, "no collection"
Did you read the other thread? The context was very clear; the buyer got upset and made a threat when the seller responded and said no to collection. In that case, the seller's lot had not offered collection and when asked, they responded and said no collection.

So yes, it is very specific - to the context.

In this case, the seller hasn't responded; if they do then I'll accept their reply (as I've already said).

Some are contending that the case is in itself is a conscious reply from the seller, but it appears that it isn't at all, and it's actually an automated system which occurs regardless of any messages.

If you can't see that the two situations are quite different, then suit yourself.

Incidentally, I'm just back in from collecting a complementary product from another ebay seller.

It turned out that they had two of them and also one of the item which is the subject of this thread.

I did a deal with the seller there and then, and bought all three for a tenner.

Looks like livechat didn't even understand that you have to uphold YOUR end of the deal first, i.e pay for your item before the seller can complete the transaction by sending you the item.

And you seriously believe that they will remove a non-payment strike when you haven't paid?

Its exactly the same - the seller has not responded cos YOU will then get upset and no doubt give them a load of crap.

Sellers have simply learned not to engage with none paying time wasters.

You clearly don't practice what you preach.
    How do you know that?

I've stated my position on that, as you well know (but maybe choose to ignore).

I've already mentioned my ebay transaction count, and the only non-payment in those 1000+ transactions was for an item which turned out to be a box without the product in it.

As far as not engaging, you seem prepared to, even though you aren't involved in the transaction.

I don't know if you have had issues with ebay yourself which you need to get out of your system, but projecting them onto me isn't really going to help you with your demons.

I'm not a non-paying bidder; I'm a bidder waiting for a response to my question before I pay.

I certainly practice what I preach, and I've responded to plenty of questions here!

Seems like you've been lecturing a lot about the rules of ebay, but the livechat response from ebay contradicts your beliefs.

Ebay reps are not the brightest. Heres my live chat:-

    Techspec
"Hi, Prowla insists on coming to my house - what shall i do"

    ebayrep 17:38:52
Call the police - thats what i do when i have a prowla outside my house

    :rotfl::rotfl::rotfl:

Last week live chat said sellers should contact buyers asking them to remove low stars.

The people on here, who you are having a pop at, know very well that Ebay will suspend accounts of sellers who contact buyers about low stars.

Buy hey, it must be true - cos live chat said so.
