Take over of a business/comany

Hello all,just one or two questions someone may be able to answer,for me.
How do takeovers from one business to another work,do all rights stay in place ?
As i have been on long term sick for a while,but a long term employee,over 10 years,i have heard of a take over whilst on leave.
I have had no contact with my employer,last December 2013,one human resources,who was dealing with me has now a dead phone number and i have also contacted by mail,letters and sick notes regular,but as to yet no correspondence.

Would i know if i was terminated on ill health,would i received a letter stating this ?if a new employer did not want me on there books ?

    Wow.


    Google "TUPE" and read up on your rights of employment. Then you MUST contact the company and find out who owns it.
    Are you getting Sick pay at all?


    Do you have a Return To Work date planned?


    Any Sickness Reviews planned?


    Who is your Line Manager that signed you off sick?

    Depends on the type of takeover on what happens. TUPE does not apply in all cases.

    Assuming a Ltd, if someone has bought it (including another Ltd), then TUPE will protect in 99% of circumstances.

    My line manager has changed three times since been off work,I was in contact with the manger I knew,then everything went through a second hr.
    I do not get paid sick pay and was pushed on to esa,the last I heard was as stated December,when I was given a ultimatum to return in January of this year (which was not ready) and if not they was going down the disciplinary route on ill Heath grounds.
    So heard through the grape vine and checked online and see it in black and white it had been bought,oh and the human resources direct conatct number no longer exists.

    In many cases of a Ltd buy out TUPE does not apply as the business entity never changes so the employer never changes just the share ownership.
