Hi and good morning,just want to know if someone,who has not been getting paid at all and had been on long term sick from a company/employer and the company gets sold out,without them knowing what's the next plan of action ! Last contact wax January 2015

I presume you mean January 2014.
I think more info is probably needed on what you mean by 'the company gets sold out' (as the details will determine if TUPE applies or not), but I'd suggest that the best action for the individual involved would be for them to get in touch with their employer and ask for clarification as to their position - there's no 'one size fits all' rule to be followed here that I'm aware of.0 -
Yes sorry January 2014,last I heard from there human resources,I was getting first warning for being on long term sick,then there was going to be yet another meeting,but as to yet nothing,I keep them updated I.e with sick notes and always send them by recorded post,but heard from one of there employees that it being taken over by another similar company.0

Write to your current employer - 'signed for' service - and ask them specifically what is happening with your continued employment.
Only they will know the terms of the change.
It's poor that your manager hasn't kept in touch.

Update already been taken over,managers changed like the wind once I was on sick leave,I don't know when I would be available to go back,0

How do you know the change has occurred?
How long have you worked for the company?
I'd suggest still writing to the registered office of your employer and asking for clarification - ASAP.
As to your last contact with your employer, you say you received a letter mentioning a warning... I suggest you read that carefully again just in case it asked for something that you may have overlooked.:hello:0 -

Worked for currently 15 years
Last two and half I've been on benefit as employer did not pay sick pay,did have a ultimatum to go back on January 2014,but was still unwell and had a sick in place up to march,they also got one send when that one run out.
I also went back on a temp basis before claiming benefit I adjusted hours etc but didn't work out,I also wasn't informed that there previous hr had resigned and that was six month prior to me contacting them in October last year,nor did they inform me about my manager leaving.
I have had no notice nor holiday pay or p45.0 -
Sorry you've been on sick leave for 2 and a half years?! I would say they've been very patient.
Your post really isn't very clear. Why would you have expected a P45 if you're still employer there? Why should they have told you about an HR officer leaving?Sealed Pot Challenge #239

In the last letter I had sorry the meeting was in dec 2013,not jan 2014,it states that if I did not return and the end of January even though I had a sick note in place,
It says :
'I feel it prudent to warn you that should you not report to work on jan14,further I'll Heath medical capability disciplinary action may be taken up to and including dismissal'.
The letter I'm reading from was :re final written warning which I could appeal against five days after I received.
Maybe I'm jumping the gun on the p45,but when your leaving messages and writing letters to any business it would be decent to tell you a hr who has been dealing with you for last two years had left.0 -
Why should they tell you about any changes to the personnel at the business if you aren't even there?0
