not sure if I can appeal an ANPR Ltd PCN

    No No, the client was more than happy with the service and signage but I was too nauseous to write that into the post earlier :D

    Anyhoo I think as well as involving Trading Standards, the time has come for you to just email the BPA with scans/photos of all this drivel and complain that ANPR Ltd are still in breach of the BPA CoP and must surely be due sanctions/kicking out, for example these levels of breaches apply surely:

    3.6 Major failure to abide by the terms of the BPA Code of Professional Conduct
    4.2 Significant failure in communications to customers
    4.21 Major failure to maintain a fair and professional operation.

    I'm hoping that Trading Standards will get back to me by early next week....they were pretty good last time I had cause to speak to them, in fact they nearly ate me out of biscuits when they came round for a chat :D

    I'll definitely be filling a complaint with the BPA too.

    I'm struggling to find out who actually owns the car park, I'm sure that Mr N Martin isn't going to let me have the details if I ask him.....even though he's been in touch to enquire of how they view his companies services.

    small update to keep my time line of events straight

    Since i replied back to Mr Martin's letter requesting me to reconsider an appeal on the grounds of him knowing the area and owner. I've received a notice of intent letter which didn't make much sense at all.

    it told me that unless i'd sent a postal payment the debt would be passed to a recovery agent but it didn't say who or give details of who to pay.

    I havent replied to that as my reply asking for the appeal or popla code hadn't been fulfilled.

    Heard a little back from the Trading standards / citizens advice which told me how to appeal and what my rights are, to which i wrote back saying thanks for this but I know the appeal process.....it's the trader who's not playing ball and then went into great detail about the scam this company is running for scenarios like this.

    Waiting for a response still to that

    Not written to the BPA yet as I'd like to go to them with the full story in one go rather than play ping pong in the same manner as these !!!!!! folk.

    This is par for the course currently for Trev & Co. Same shi t, same story, different day. You need to ride this part of it out, but, in tandem, you need to back this up with a very assertive complaint to Steve Clarke at the BPA - don't hold back, keep badgering him at every opportunity.

    ANPR Ltd seem surprisingly immune from BPA sanctions - gawd, just what heinous 'crime' do they have to commit to be fully sanctioned - but eventually there will be a tipping point, you just have to help to move the counters nearer that precipice.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    The debt recovery agent is Expedion Ltd., which is actually the next desk in ANPR Ltd.'s office.

    If I were you I would send Trev something like this (as well as all the complaint stuff you are doing):

    Dear Trev

    I notice you are still sending me empty threats instead of responding to my appeal dated dd/mm/yyyy.

    As you know perfectly well, under the BPA AOS Code of Practice to which you are supposedly committed, you are obliged to either uphold my appeal or issue me with a PoPLA code. If you simply complied with your obligations there would be no need for you to correspond further with me, at all, about anything, and there would be no need for me to waste my time on the junk you keep sending.

    Accordingly, these are my terms for dealing with any further correspondence sent to me by you or by any agent of yours, other than either a notification that you have upheld my appeal, or a PoPLA code: each item received by me will incur a charge of £100, payable by you against my invoice, regardless of whether I choose (at my absolute discretion) to respond thereto.

    Sending me anything (or causing me to be sent anything) which does not constitute either a notification that my appeal is upheld or contain a PoPLA code will indicate your acceptance of these terms.


    And then, each time you get another piece of junk, send Trev an invoice for £100. In a few weeks, send him a (proper) Letter Before Claim, and a couple of weeks after that issue a Money Claim Online.

    If you really want to do it properly find out who the landowner is, send them a copy of the above, and tell them that you will hold them liable for all such charges incurred by their agent ANPR Ltd.

    That is because surprisingly few people complain.

    OP you must complain in the strongest possible terms to the BPA and DVLA about this shower.

    A small update to keep the timeline and thread in order.

    I've received word from my local trading standards office, that they've visited the car park and have passed the case over to the office local to ANPR's address.

    Since my letter to N Martin on the 7th July which set out some facts and re asking for appeal / cancellation or popla code and receiving their oddly worded "notice of intent" dated 11th, I've heard nothing further from them.

    I didn't reply to the notice of intent as I figured it had been put into the post on the same day the mysterious N Martin would have received my letter.

    Do the BPA usually acknowledge complaints? I'm yet to hear anything back from them.
