    Yep it's fine - the law is the law and POFA says a keeper can discharge liability before proceedings commence. And you did.

    Thank you both. Will send it today. One last question-are the contacts in collies link for bpa and dvla still the same? The post is from Oct last year. I will email those out later too, if they are.

    You've all been a great help. I'm sure I'll be back when I get a reply....kind of hoping they will give up. Do they just stop sending letters or do they actually tell you it's over? Is it just wishful thinking :D ?

    Argh! Really confused!

    My husband has received a letter from the debt recovery Company. It is dated the 6th May but only got here today.
    It reads like it is in reply to the last letter I sent to g24, but I didn't send this until the 8th!

    Still following ;D ?

    It states that as per the BPA code of practice, point 22.7, the driver/keeper was allowed 28 days from the date of the PCN was issued and/or 28 days from the date the Notice to Keeper was sent to challenge the apCN. The time to challenge had now expired and therefore POPLa is no longer available.

    It then goes on to stae why the PCN was correctly issued and still payable.

    Later on in the letter it also states that if I reply rather than pay, they will keep the letters on file but unlikely to reply?!

    Do I just ignore and wait for a letter from g24? In theory this was sent before my last letter. But the content had made me query this, as it seems to cover and reply to the latest letter I sent.

    They've given us until the 20th May; a ridiculously short time frame too.

    Hi Winnibags,

    The letter you have received from the debt collectors is just another begging letter hoping pester power will get you to pay up.

    It is not a response to your G24 letter because that was not an appeal - it was a complaint that G24 (and their debt agents) were continuing to pursue the keeper even though the keeper had discharged their liability under POFA 2012 by naming the driver.

    You should now follow the advice I gave you in post #45 above in which was

    Your options now are

    1/ Ignore and wait to see if they send out a Notice to Driver to you - if they do come back on and send the suggested Hot Bring letter.
    As mentioned earlier they are highly unlikely to do court - never have so far and even if they did they would stand no chance now they have been given the driver's details - but keep a look out for an LBCCC or County Court papers and come back on if you get either of those. Debt collectors letters can be ignored - they can do nothing except issue empty threats.

    PS - G24 are pathetic scammers, always beatable and liars to boot.

    Does the BPA state that the driver has 28 days then, becayse I thought that was what we were disputing in the complaint?

    Unfortunately, my husband opened the letter before I could vet it ��. He is not pleased!

    OK, so you have two current challenges :

    1. To get rid to the debt collectors
    2. To get G24 to communicate with the driver

    Here are two letters ( fairly blunt but that's what you need to use with G24 ! ). Send the first one to the debt collectors ( I've assumed they are DR+ but obviously alter names to suit ) and send the second to G24 via their website ( https://www.g24.co.uk and go to Contact Us ).

    Send BOTH to Steve Clarke at the BPA - [EMAIL="steve.c@britishparking.co.uk"]steve.c@britishparking.co.uk[/EMAIL]

    Letter one to the DCA ( probably DP+)

    Dear DP+,

    Re : PCN Ref xxxxx, Registration xxxxxx

    *** THIS IS NOT AN APPEAL ***

    Your client G24 have been informed that the Registered Keeper was not the driver at the time that the PCN was issued. The drivers name and serviceable address has been supplied. This dispensed the Registered Keepers responsibilities under POFA 2012 - i.e. the LAW.

    By continually harassing the Registered Keeper you are not only breaking the law but also the BPA Code of Practice.

    No further correspondence will be entered into by the Registered Keeper and any that is received will be forwarded to the BPA. YOU SHOULD NOW CEASE ALL COMMUNICATIONS WITH THE REGISTERED KEEPER IMMEDIATELY.

    Please note that this letter has also been sent to Steve Clarke at the BPA for him to investigate you breaking the BPA CoP and to issue sanction points against you.

    For the second letter to G24 you should send :

    Dear G24,

    I am actually still waiting for g24 to reply after sending a similar (but not as blunt!) Letter last week. Shall I wait for reply before sending yours? Or give it to them with both barrels?!

    I am hopefully going to the 'address' of the driver over the weekend. You never know-i may find a pcn in my name waiting for me.

    I can't believe that DR+ post takes over a week and half to reach the recipient! That's what has thrown me.
