    You are not out of the woods, though, even with that letter. Many PPCs will simply say "You have not replied within 28 days, so it's on your head" and the debt collectors will keep writing.

    However, the only way they can get money from you is to take you to court. And only the PPC can do that, so knowing who the PPC was gives us a chance to say what their record is on doing court.

    Please keep all future correspondence safely and you only really need to come back here if you get a reply from the PPC accepting that they will go for the driver or (b) if you get a Northampton court summons or (c) a letter before claim from the PPC.

    G24 Ltd. Get hubby to send the letter to them to identify you. (You're sure there has not been a windscreen ticket?)

    Then once you've received a PCN in your own name, send the appeal as per Hot Bring's threads. (Search this forum for G24 - you'll find lots of hits and copies of the appeal). HB's appeal has worked every time so far with this PPC. :)

    To the debt collectors, all he needs to send is something like ...

    Ref. PCN XXXXX
    Dear [Debt Collector Company],
    As registered keeper of the vehicle with the mark XXNNXXX I deny any and all liability to this debt. I have written to G24 Ltd to identify the driver in respect of this PCN and as such have discharged any liability under POFA2012. Please refer this matter back to your client.

    Any further correspondence from yourselves will constitute harassment and may be pursued accordingly through the courts.

    Yours faithfully,

    So G24 ltd are a big company?
    The letters he did open (months later) honestly looked like junk mail-I realise that is not a good enough defence! But we're in shiny envelopes.

    With this ppc, do they normally back down once you make your first appeal? Or is this likely to drag.

    I feel stupid saying this-but I'm honestly tempted to pay to just get rid of the stress of it. Is it likely to go to court? And if so, is that going to cost hundreds?

    My husband hasn't seen the new letter. I saw the information through the postage window and panicked and opened it. I am not looking forward to his reaction.

    G24 are NOT a big company. They have a few monkeys ( less than London Zoo ) working for them and they are run by a corrupt bully called Adrian King.

    As Bod has said, get your hubby to name you as driver and then, when you get the charge in your name, send the following :

    Dear G24,

    This is an appeal against the charge issued to the vehicle with the registration XXXXXX, charge reference XXXX.

    It is the drivers assertion that :

    1. The charge is not a genuine pre-estimate of loss.
    2. The signage does not conform to the BPA CoP to which G24 has committed.
    3. G24 has no authority to issue charges over the land in question.

    As such the charge is rejected. You should now either cancel said charge or provide a POPLA code for the registered keeper to appeal to the independent adjudicator.

    Any further correspondence other than confirmation of cancellation or a POPLA code will be considered harassment and could result in legal action being taken against you.

    Thank you, all. You've been very helpful and definitely calmed me down!
    I'll report back if I find an address etc. I have a feeling I may have to ask in a shop. A bit worried they won't be able to help as it isn't really their car park, but on next to the back of their unit iykwim.

    Seriously - don't make this more than it is ... an unenforceable speculative invoice. Just follow the process outlined above to get it away from hubby, then send HB's appeal exactly as worded once you receive your own PCN. :)

    I have the address!
    Went into the store as I couldn't read the small print on the sign. The woman I spoke to was lovely (she had also been caught there) and said it was ridiculous as it was the only paet of the retail park with any restrictions. It is also the second car park of a well known toy store. The main car park doesn't have the restrictions either!

    My husband has been told :embarassed: and he is leaving it all up to me. So I'm going to follow your advice.

    One last question: do I need to make any reference to the fact my husband didn't contact them within 28 days? I'm guessing not unless they bring it up-but any suggestions if they do? Does he deny knowledge of letters? They can't prove they were delivered can they?
