just have him send the RK letter on page 1 that names the driver + address (use an alternative postal address if possible, like a relatives) - get a pcn in your own name , then follow the newbies sticky thread

they cannot prove anything, so the less said , the better

admit nothing (like a NO COMMENT interview)

just have the RK send the letter naming the driver

Glad you now have the address for G24.
Just send the letters as advised - no need to add anything or try to explain.

Send this one to G24 from your husband now
    Dear Sir

Vehicle Registration Number [insert reg number]

I am the registered keeper of the above mentioned vehicle.

I am writing with regards to Parking Charge Number xxxxxxxx and wish to inform you that I was not the driver of the vehicle on the date of the alleged 'parking event'. Therefore you must pursue the driver, whose details are:

    [INSERT NAME]

    [INSERT ADDRESS]

Please note: this discharges my obligation as Registered Keeper under PoFA 2012 and any court proceedings will be defended on that basis.

    Yours faithfully

    PRINT NAME

Send this one to the debt collectors from your husband

To the debt collectors, all he needs to send is something like ...

    Ref. PCN XXXXX
    Dear [Debt Collector Company],
As registered keeper of the vehicle with the mark XXNNXXX I deny any and all liability to this debt. I have written to G24 Ltd to identify the driver in respect of this PCN and as such have discharged any liability under POFA2012. Please refer this matter back to your client.

Any further correspondence from yourselves will constitute harassment and may be pursued accordingly through the courts.

    Yours faithfully,
[Print Name - don't sign, or just put a squiggle. They don't need his real signature]

Then wait for the Notice to Driver to arrive in your name and when it does send Hot Bring's letter below

    Dear G24,

This is an appeal against the charge issued to the vehicle with the registration XXXXXX, charge reference XXXX.

It is the drivers assertion that :

    1. The charge is not a genuine pre-estimate of loss.
    2. The signage does not conform to the BPA CoP to which G24 has committed.
    3. G24 has no authority to issue charges over the land in question.

As such the charge is rejected. You should now either cancel said charge or provide a POPLA code for the registered keeper to appeal to the independent adjudicator.

Any further correspondence other than confirmation of cancellation or a POPLA code will be considered harassment and could result in legal action being taken against you.

    Yours,

    Print name ( don't sign ).

Make sure you send them from the post office asking for a free certificate of posting - that is legally deemed to arrive by day 2 from the date of posting.

Also make a note of what you have discovered today regarding how confusing the set up is in terms of knowing where parking is and is'nt covered by G24 and keep it to oneside as this will come in useful when/if you reach the 2nd appeal stage (POPLA).

EDIT: Sorry for the crossover Redx - forgot to check for other responses after drafting the above

Thank you, Redx. A different postal address is a good idea. That's not going to come back and bite me though is it? Or maybe state that he has been staying at anothwr address (hence not opening mail? ).

And RK letter? Sorry, I'm not sure about the abbreviations. Is RK a poster?

RK is Registered Keeper, the person named on the V5C (log book)

you can use any address you like as long as the driver can get the mail from it, doesnt have to be the same address and its better if it isnt

no it cannot cause you a problem, as long as you can pick up mail from there , so your mums , sisters , brothers , whoever

remember , you are actually naming the driver here , so nothing to do with the RK details

remember, say as little as possible (you appear to want to say far too much , little is more here), so just follow the templates above , no ifs , no buts

    good luck

I will follow the templates to the letter!

I was only asking about the address if this goes to court. Wouldn't it look bad if I had put a different address?
    Im worrying too much aren't I? :D
