Hi Claire,
Just read the thread again from your phone call with OR office...What an absolute COW that person sounded....there was no need for her to talk and treat you like that..it wasnt as though you didnt want to pay but only that you pay the right amount and sign the correct docs.
Well done on sticking to you guns as sometimes it is easier to give in and sign but you've done right in what you said/done.
I totally agree with Fermi about writing the letter to the OR - marking it personel...i would certainly recommend sending it via recorded so in future they cant say anything about not having received it.
Good luck and i will look forward to your posts on this matter in the future.

I've deleted the letter, as someone has pointed out, the OR or someone from that office may read this forum!Sometimes you have to go throughthe rain to get to therainbow0

Hi Claire,
Good, well written letter. I would add resolution date ie ` I expect to hear from you by...` just to show them you mean business. Of course in the `real world` institutions are never able to abide by these dates but shows your commitment.
Also on subject of this employee`s rudeness towards you on the phone..I am alarmed at what I have read & experienced personally recently (my OH going BR)... when you are in debt or debt related situation suddenly we become a `second class citizen` !!! Respect is a basic right of us all & we should all challenge disrespectful behaviour..whatever the circumstance!!
Anyway good luck with IPA.

Thanks Angel,
It's disgusting isn't it. I can't believe someone from the IS can talk to people like that! I'm just glad I stood my ground, sometimes I'll just agree to things and then regret it later but after the way she spoke to me there was no way I was going to let her walk all over me! I'm just glad it wasn't someone who it might have REALLY upset, bankruptcys hard enough as it is without having to deal with situations like that. I hope she get a telling off but I'm pretty sure she won't for some reason..........Sometimes you have to go throughthe rain to get to therainbow0 -
Most likely an examiner I think, but probably a junior one. I suppose possibly an admin assistant rather than an examiner, but I wouldn't have thought they would be ringing you.
It's easiest if I just pinch this explanation from TalbotWoods on DebtQuestions, as it saves rewording the same.
It is a misnomer that each case is dealt with by the OR themselves, as they are there to oversee, the functions of the office and to deal with legal mattes involved in very complex cases.
You then have assistant ORs who oversee groups of examiners, and again deal with questions they cant deal with.
There are three types of examiner (and it is normally these who deal with our cases) B1, B2 and B3 grades of examiner. The B3 is the lowest grade and deal with simple cases (which most personal bankruptcies fall into) B2 tend to deal with small business bankruptcies that require a higher level of skill and experience, finally there are the B1 examiners who deal with large companies, complex redundancy case, criminal bankruptcies, and the very juicy cases.
Now when the examiner has dealt with your case, or there is a period of paperwork inactivity between parts of your case then the examiners assistants will deal with the very routine matters (OK they my not be routine to the individual, but in the big game they are routine in the ORs office) thus freeing up time for the examiners to progress other cases.
What you need to is bump your complaint up that chain a bit.
Talbot Woods has got B1 and B3 the wrong way round, but otherwise it's correct. And if your case has gone to RTLU, it won;t have been an examiner but more likely an admin person0 -
Thanks for that Fermi, thats a really clear explanation of who deals with what.
I've just called the OR's office to ask who the assistant OR is and he said there was no one allocated to my case???? I said I need to write someone a letter of complaint and he told me to address it to the offical receiver.
What I'm guessing will happen is that his PA/Secretary will open it and pass it down the chain, what do you think??
That could happen if your case has been passed to RTLU, as they have a different structure. Address your letter to the RTLU Manager.0 -
JCS1 would this be in the same building?
I'm sending my letter off tomorrow morning. I feel a bit worried that it means they might start looking at my case with a fine tooth comb, but it's not like I have anything to hide. I just hope that this woman realises that in future she needs to treat people with a bit more respect, even us lowly bankrupts!
Thanks!Sometimes you have to go throughthe rain to get to therainbow0 -
Ok just dug our some papework
It would seem the woman I spoke to is a Case Officer. I also have the name of the assistant OR from a letter dated August last year.
The letter I received signed by the horrible woman came from the RTLU - should I address it as JCS1 says to the RTLU manager?? Thinking this may be best.Sometimes you have to go throughthe rain to get to therainbow0 -

Not always in the same building, tends to be one RTLU per region rather than for each OR Office0 -
Aaaah yes, it all makes sense now!
Thanks for your help.
Incidentally, did you see the letter? Did you think it was ok?Sometimes you have to go throughthe rain to get to therainbow0
