Personally, If you feel you have been treated unfairly then I would complain.
Did the examiner say that they would need to check with a superior?Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

No she didn't say anything.
So the person who I've just spoken to, what position would you think that she would hold? She did seem a bit full of self-importance and seemed annoyed that I didn't just agree to do what she said. I've got a feeling she was some kind of clerk that's got ideas above her station   Think we all know one of those!
Right I'm going to draft a letter tonight (when I've calmed down enough to write it and not rant it :rotfl: ) and will be back later on to post it here to see if I can add anything or should take some bits out!Sometimes you have to go throughthe rain to get to therainbow0 -
Most likely an examiner I think, but probably a junior one. I suppose possibly an admin assistant rather than an examiner, but I wouldn't have thought they would be ringing you.
It's easiest if I just pinch this explanation from TalbotWoods on DebtQuestions, as it saves rewording the same.
It is a misnomer that each case is dealt with by the OR themselves, as they are there to oversee, the functions of the office and to deal with legal mattes involved in very complex cases.
You then have assistant ORs who oversee groups of examiners, and again deal with questions they cant deal with.
There are three types of examiner (and it is normally these who deal with our cases) B1, B2 and B3 grades of examiner. The B3 is the lowest grade and deal with simple cases (which most personal bankruptcies fall into) B2 tend to deal with small business bankruptcies that require a higher level of skill and experience, finally there are the B1 examiners who deal with large companies, complex redundancy case, criminal bankruptcies, and the very juicy cases.
Now when the examiner has dealt with your case, or there is a period of paperwork inactivity between parts of your case then the examiners assistants will deal with the very routine matters (OK they my not be routine to the individual, but in the big game they are routine in the ORs office) thus freeing up time for the examiners to progress other cases.
What you need to is bump your complaint up that chain a bit.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thanks for that Fermi, thats a really clear explanation of who deals with what.
I've just called the OR's office to ask who the assistant OR is and he said there was no one allocated to my case???? I said I need to write someone a letter of complaint and he told me to address it to the offical receiver.
What I'm guessing will happen is that his PA/Secretary will open it and pass it down the chain, what do you think??Sometimes you have to go throughthe rain to get to therainbow0 -
Odd.
In that case I would be inclined to put on the the envelope and letter:
FAO: The Official Receiver or Assistant Official Receiver ONLY.
But there are a few (ex) examiners that post on here sometimes, so maybe they can help you work out who best to address it to if they come on later.;)Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi Claire
just reading about your nightmare situation - for what its worth i think you're doing the right thing - they seem to have made an IPA appear from thin air! Btw with the housekeeping - I was only allowed 181 but intend on upping all my figures come my annual review. Sadly, I have just received a payrise (2.5k) and I can see my IPA rising excessively. At times, its difficult not to see an IPA as a noose around your neck....
congrats on the weight loss tooBCSC Member 70:j

Hi Claire,
Sorry to hear your still having problems, try to stay positive and dont do anything that your not comfortable with until you have sort every advice available.
Keep strong, but most of all calm and stick to your guns if you feel your right !(I would be doing exactly the same as you)
Best wishes x0 -
Thanks guys.
I'm going to put my SOA in with the letter and explain to the OR that although the guidance is £160 for a single person that this is unrealistic given the amount things have gone up recently i.e. bread etc. I put down £200 9 months ago and I've resubmitted at £220 - 5 pounds a week more. She didn't even tell me what was being disallowed! And it seems convenient that one minute she didn't have my new SOA and then the next she did.
I'm wondering again whether OR's are on some kind of commission/bonus for each IPA they set up, does anyone know??Sometimes you have to go throughthe rain to get to therainbow0 -
OMG, now thats a scary thought Claire, shouldnt think that would work surely
