    So how can the email not have arrived? Must have gone into the spam/junk folder? Or did they never send it...a PPC could easily cobble together a draft email and slap in any unused POPLA code from the same day.

    Was the POPLA code dated the same day as the email?

    You can see whether it was sent to the proper email address from the copy email the BPA sent you. If the copy did not show the email addy it was sent to, follow this up and demand to see where this email was sent to because you did not receive it. Emails don't just disappear unless deleted or sent to the wrong address, or if they were never actually SENT! Push for evidence that this email ever existed - after all these complaints are costing you nothing - and PPCs have lied to the BPA before:

    If your complaints come to nothing - or you find the email in your spam/junk folder - just remember that you are in the same position everyone always was, for years, before POPLA ever existed. The sky didn't fall in when we all ignored debt collector drivel before POFA 2012! I still have my collection of debt collector letters from 5 years ago, it's no biggie to ignore them after all.

    If it's a PPC which occasionally tries a small claim just post back here for defence help if it happens - again not the end of the world and certainly defendable (their photos being dated 1st March won't help their case but there are several defence points to any fake PCN).

    seems to me that its the refusal and popla code generation by email that caused this confusion, which is one reason we advocate waiting for a written NTK , because in this case I dont see that the DVLA DATABASE was accessed due to the driver appealing online and the refusal sent by electronic communications

    Could have been in my spam...Yahoo deletes it every week.

    They did attach the original email in the appeal rejection. But like you said anyone could have made that up!

    Yeah popla was from 1st March.

    Everytime I complain to the PPC they keep replying from DR+ Email address telling me to use their company for communication instead.

    What makes me laugh the most is them saying sending a text message is their attempts to contact me!!! And that I chose to ignore them! Haha!

    The text messages had no reference they were to do with the fake PCN. They mentioned DRPL who at the time I didn't know until I did a google search!!

    OK, just keep all the letters in case you ever need to defend a silly speculative small claim. And as far as texts or phone calls are concerned, search this forum for 'Roxburghe phone calls' as there are some older threads around which went into this in detail when another debt collector, Roxburghe, were annoying people by phone (they still do I am sure). The older threads explained what to say to make them stop, and a few jokey ideas like playing 'Agadoo' down the phone or saying 'just one moment I'll get a pen' and then leaving the phone receiver dangling and walking away to have your dinner and watch the evening film on TV!

    Understood CM. :-) I had to google "Agadoo" it was 2 years before I was born haha :-)

    Well as part of my complaint to BPA I mentioned some stuff from Martin Lewis on how to get them to stop texting me. Mentioned "I will report them to the Information Commissioner (ICO) for breaching of the Privacy and Electronic Communications Regulations (PECR). "

    I'll keep this forum in mind and update accordingly for reference for other user to read with similar issues.

    I can only find a JD parking court case from a few years back when they could still clamp. So maybe it's all empty threats as discussed.

    It shows they don't have a clue. If they were that confident of winning they'd give me another POPLA just to shut me up so in their eyes it would fail again!

    Surely they must be running out of paper soon? :-)

    Also they are claiming £25 for Solicitors fees - it's a small claims case if they took it to court! They can't do that!
