I have a court date on the 28/08/07 against RBS. The court has told me that the case has been allocated to the small claims court and that each party should send all copies of all documents on which i intend to base my case, to the court and the other party. Is this what is called a court bundle and what should it consist of. Also the last calculation of interest i informed RBS of was over 6 weeks ago. As the weeks go on this is increasing should i be supplying RBS with regular figures.Plus can i claim interest on the £120 court fee.0

Right, my bundle has been sent to both the court and Barclays.
In the same respect should Barclays have sent me a copy of the evidence they intend to use to defend my claim?0 -

If the judges "Order" says each party should "file and serve" their papers, yes, they should (like you) send to both the court and the other party. "File" means to the court and "serve" to the other party.
If Barclays do not send their papers in the specified time, post on here and I'll post the letter applying to the judge for judgement by default (if you haven't already found it on the CAG website). This has happened to me ... the bank have not submitted their court papers, although I have, and I've just sent the letter to the judge and am awaiting his reply.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
Hi I've got a hearing date on the 7th August 2007 at Bow county court.
I need to provide the court and other party with a court pack or something 2 weeks prior to hearing.
I need some help with what to include in this - and I also need help in trying to get a copy of the HSBC terms and conditions/services leaflet prior to 2004 or from 6 years ago to before the banks caught on to the reclaiming.
Im worried! Im claiming £5k inc interest and this has been going on since December 06! (they having offered me almost a grand under my initial minus interest claim) And now I've got to tackle the court - while every other person I helped got their money straight away!
cheers
Presumably you've had the judge's "directions" together with the court date? If you post the directions on here, I'll try to help. You need only submit what the judge asks you for, which may well not be a complete bundle.
Your HSBC T&C's have probably been posted on the CAG forum ... have you looked there? Here's a link where you may be able to find the ones you want :-

If you're struggling, you'd be wise to start a thread on the CAG site under the HSBC forum.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -

Again, what have you been asked for in the judge's "directions" ... difficult to advise if we don't know what you have to provide
Post them on here so you can get some guidance.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
what exactly does being well prepared when you go to court mean. the only evidence i have is the statement (with the charges on it) from the bank that i requested.
Where are you up to? You're hardly going to be "well prepared" if you've only just started your claim. You have a long way to go before you get a court date from the sound of it ... you'll understand more and be far better prepared as you go along. BTW, it's highly unlikely you'll actually get to court, more often than not, the bank's settle before.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
I'm at the court bundle stage now and really scared where do I find it and how do I fill it in I've read it can be hundreds of pages long scarey!!!!!:eek:Debbie Jones0
