I have been given a court date for my case against HSBC. I did not have to fill out an allocation questionnaire as I had a letter from the court telling me this had been deemed unnessesary. However my letter telling me the date of the case asks me...

'42 days before trial, file at court and serve upson the claimant a detailed witness statement exhibiting a schedule of the dates and amounts of all the charges in issue and the extent to which they are disputed and for what reasons'

I can't seem to find that in Martin's information. Can anyone help me?

Check the above posts by MimiJane regarding the "witness statement".

Just getting my bundle together now so a few more questions.

Are there anymore charges i have to pay? I've already paid MCOL £120 for the initial claim.

What should i do for the correspondence. I've misplaced the initial few letters where natwest acknowledge the claim. Is there a statement regarding this i can enter? I have the offer letter they made me and the latest defence they made.

I'm going to make a list of the latest schedule with interest up to todays date. I assume that will be ok to deliver?

With the rest of the bundle being cases i should just go through and print off?

And could someone link to me to the Natwest T&C 2003. I'm having a hard time tracking them down.

Sorry for all the questions. I want to get this sorted asap so i don't have to worry about anything more until then.

    Thanks

Have you looked on the CAG site under Nat West T&C's? Here's the link :-

As I have mentioned before, I am in the process of preparing the Court Bundle. I have spent an awful lot of time and effort, researching and printing etc. I am very interested in the fact that someone has had an award made for their time, ie, £230.00. When would be the best time to add this to the claim? I am about to update my interest claimed to go with the Court Bundle - should I add it in now with that?
There are three ways to get something done; do it yourself, hire someone or forbid your kids to do it.

No, it's best to wait until just prior to settlement, when you can make a FULL claim for all the paper, ink, letters, preparation time, etc. You won't know until this time exactly what you've used. You firstly ask the bank to include this in your settlement figure. They'lll probably ignore you, then you apply to the judge.

There's lots of info. re. this on the CAG site, which tells you the correct way to go about it, gives you templates to guide you and also gives you (the litigant in person) the going rate for preparation time, letters you've sent, etc. See the following link :-

    http://www.consumeractiongroup.co.uk/forum/bank-templates-library/85726-wasted-costs-order.html

See this thread by someone who won their case and also won their wasted costs submission (though the judge did cut down on their preparation hoursrolleyes.gif) :-

I'm just starting to prepare mine ... up to £400 already, though I don't think I'll get this. It's certainly worth a try, though don't bank on getting the full amount (you may get nothing at all, it depends on your local judge). It appears that someone got £85 (though they applied for about £300), but another got around £400.

Remember, leave this 'til the last moment, when you've won your case (hopefully!).

Hi, I need to prepare my bundle now for court (against HSBC) and the CAG site says I need the terms and conditions from my bank. I'm sure these have changed recently in favour of the banks - how are you guys getting yours? I don't have old copies and want the T&Cs to be relevant for the term of my claim?

There's a thread for T&C's relevant to every bank on the CAG site. It may be "lost" somewhere within all the threads. Have you looked there? Failing that, within the T&C thread, you should find a link to an "archive" website which give you many years not listed on CAG.

Hi I've got a hearing date on the 7th August 2007 at Bow county court.

I need to provide the court and other party with a court pack or something 2 weeks prior to hearing.

I need some help with what to include in this - and I also need help in trying to get a copy of the HSBC terms and conditions/services leaflet prior to 2004 or from 6 years ago to before the banks caught on to the reclaiming.

Im worried! Im claiming £5k inc interest and this has been going on since December 06! (they having offered me almost a grand under my initial minus interest claim) And now I've got to tackle the court - while every other person I helped got their money straight away!

    cheers
