You'll find the link to the Court Bundle at CAG in Martin's article.

Apologies if this has been answered already in this thread, reading 14 pages would space me out for the full day.

Do you include all original papers in the court bundle or are copies acceptable. The reason I ask if that I have had may legal papers go missing over the past couple of years to me and also to courts and solicitors. A couple of years ago someone actually tried to take a mortgage out on my property, i got that letter .

This was not included within the CAG template, is it OK to submit ?

I have also got a copy of the current terms and conditions for my account together with tariff of charges, should I included these within my bundle ? I have requested a copy of old T+Cs from the Abbey but am not holding breath fro them, If I dont have old T+Cs will this affect my claim.

Any advice massively appreciated as I've come so far ( since Feb 07 ) and don't want to drop clanger at this stage.
I am just putting together my Court Bundle and I wasn't sure what to put in my covering letter so thanks for that, it doesn't really give any guidance other than saying what documents you need.

You can find Abbey T & Cs (my claim starts 2001) on the CAG website but it said that you did not need them as Abbey are not disputing they have levied a charge or something. I can't remember exactly but I did find it and I have decided not to bother. Sorry I'm a bit vague but it's there if you have a good search for it.

Might be a stupid question but I've prepared my court pack and am ready to submit, but I'm currently working away from home, so not near the court. Can I just post my documents?

Also do I have to send a copy to Barclays direct or does the court forward it? If Barclays direct what address???

    HELP!!

Make sure you've followed the judge's directions and are supplying everything you've been asked for. Post Recorded Delivery to the court and the bank direct (the court do not do this!). The correct bank address should be on here in the step-by-step instructions. Also, do a copy for yourself (3 in all) and keep the originals safe as, if it does go to court, the judge may ask for them.

  • Hiya,

I was just wondering what the average time was from getting a letter stating your court date to when the actual court date was?? it seems to be a few months....is this right? I thought it would only be a few weeks!! Does it depend on the court? and also, we have recieved a letter stating "Notice of transfer of proceedings" so within what time scale should we recieve the next letter with the court date??

    any help would be appreciated,
    Thank you

It depends entirely on how busy your local court is ... it could be a couple of weeks or a few months before your hearing date, it varies greatly.rolleyes.gif Of course, it's highly unlikely you'll have to go to court, it'll be settled before then more than likely.

I have been given a court date for my case against HSBC. I did not have to fill out an allocation questionnaire as I had a letter from the court telling me this had been deemed unnessesary. However my letter telling me the date of the case asks me...

'42 days before trial, file at court and serve upson the claimant a detailed witness statement exhibiting a schedule of the dates and amounts of all the charges in issue and the extent to which they are disputed and for what reasons'

I can't seem to find that in Martin's information. Can anyone help me?

They just want some more detailled information about the charges involved.
Add a column to your list of charges with the reason for the charge. Use what you did (ie. late payment, going overdrawn) rather than the bank's description on their statement (ie. service fee).

Just getting my bundle together now so a few more questions.

Are there anymore charges i have to pay? I've already paid MCOL £120 for the initial claim.

What should i do for the correspondence. I've misplaced the initial few letters where natwest acknowledge the claim. Is there a statement regarding this i can enter? I have the offer letter they made me and the latest defence they made.

I'm going to make a list of the latest schedule with interest up to todays date. I assume that will be ok to deliver?

With the rest of the bundle being cases i should just go through and print off?

And could someone link to me to the Natwest T&C 2003. I'm having a hard time tracking them down.

Sorry for all the questions. I want to get this sorted asap so i don't have to worry about anything more until then.

    Thanks
