  • Yes the gas was checked 2 weeks after we moved in but the wires we have told him about are definatley live as my cousin is an electrician and he has tested them . he has covered them as a temp mesure but they really need sorting . i have asked him for his address but he will not give it me all i have is a c/o address for his work put not garanteed to get to him as he works for magistrates court services!!!

    Do not pay another penny, I doubt the LL will come after you. From everything you have said, it seems the LL is being very wary about leaving a papertrail for whatever reason.


    Trust me, there is enough tells in your post to say you wont ever get your money back.

    id contact whoever it is and raise a claim for the 3x value of your deposit back.
  • Thanks for your replies they have been more than helpful.My problem is i cannot cope with confrontation(bit of a wuss lol) and im worried he is going to turn up if hes that desperate.He is going to ring me again at 6.30pm.Do i just write to him at the c/o address?.The property is absolutley in the condition as when we moved in apart from the repairs.I will never rent privately again,i cannot bare it.Ive only rented two houses in my life as i have always owned my own but due to my complete and utter bad luck (and with the help of a very incompetant solicitor!)managed to lose my home due to a neighbour boundry dispute costing me£ 49,000 !! .Im just wary its going to cost me again .

    Your contract requires an address for the serving of notices. I assume that this is the work address?

    If so, write to him at the work address. Two copies sent first class from different post offices with free certificates of posting. Any court would consider this evidence that he had received the letter two days later.

    Stop speaking to him on the phone.

    Tell him in the letter that all future communications are to be in writing.

    And speak to Environmental Health ASAP.

    If the LL starts ringing, texting, e-mailing a lot, then try and get hold of Shelter or a local tenancy advice centre as this could (not would but could) be considered harassment. Keep copies of all communications from him (which is why you need writing rather than speaking on the phone.

    And if he threatens to sue for the rent, then send notice that you intend to start action for the 3 times penalty.

    If he is difficult tonight, then tell him you are going to record the call.

    Relax.

    If he turns up, he might shout and bang on the door. Just record it on your mobile phone, tell him to go away and write if he wants to communicate. Then phone the police (esp if he threatens you) and tell them that you are afraid of what he might do and you want him removed.

    If he persists and is threatening then it can count as harrassment and illegal eviction, which are criminal offences.

    As for the address; it this an address on the tenancy agreement? If so, it will be valid for the service of notices, though it can complicate enforcement on a judgment if you don't know his home address. There may well be ways to find it out however.

    As for him coming after you for the last month's rent, he simply isn't going to do it because you can counter-sue him for non-protection of the deposit and you will win. Same for any deposit damages issues, unless you do something really big.

    I agree with the others that given what he has said about his financial situation you would be foolish to give him the last month's rent without a protected deposit. If he had protected your deposit, I'd be telling you to pay.
  • He keeps texting and saying he wants to come to the property for an instection tomorrow as it states in the tenancy. all i keep asking is if my bond is protected and he simply refuses to answer.I have told him i need it in writing for the inspection but i will not be available this week as my hubby is working away but he insists he is coming tomorrow and he will be coming in . He says he wants his rent tomorrow .

  • So he can coe tomorrow? and can come in? . Im not trying to be difficult but i dont trust i will get my bond from him . Has he not already breached his tenancy by not depositing my bond? .

    He has no right to enter the property without your permission. If he does, call the police. I would personally be investing in a solicitors letter right about now.
