that is because the private companies misuse the blue badge as being relevant in parking in those bays , when actually it is not relevant and the actual relevant law is the EA 2010 which they do not adhere to at all , but is highly relevant to the landowners who actually own the land
you are taking the word of the parking company and their rules above the law of the land , its the law of the land that is relevant here and would apply even if the lady in question had no blue badge, because the blue badge is not what is relevant here , despite the signage
it is your intransigence in this matter that makes me write the words in a blunt fashion, because I believe in plain speaking and so I am being blunt from the outset, not rude, because you need to wise up quickly and try to avoid the pitfalls of court if you do not change your obstinate attitude to these invoices or to the people giving you the correct advice in a very blunt and to the point fashion , I make no apology in being totally blunt about the issues here, even if its only to dispel the myths that you currently hold as regards these matters as can be seen by your posts up to now
once you get the hostility out of the way and learn the relevant issues here you will see how candid and blunt my replies were , BUT also you will see how correct they were, but until now you are being hostile to the advice received as if you know better than we do, or I do , when you know what I know, you will change your views, the hard part so far is getting you to see that the advice is 100% correct , so stop arguing and start learning , before you get any deeper into the myths you have surrounded yourself with so far

It's not a case that I have not researched the subject properly more that I have only just asked the question to get some helpful advice and until 7pm when my children go to bed I will not have time to research the subject properly as you say.

by page 3 he now gets what we have all been telling him and has now apologised because he told all of the respondents off earlier in the thread because he thought it was hostile and bad advice, yet has finally realised the essence of what he was told all along, the truth of the matter, and the information he needed to take it further

I understand what you're saying but if a person has answered the same question 20 times in a day and they feel they can't be polite when answering the same question then maybe they should scroll on and leave it for someone else to answer, There must be thousands of people on this site, I'm sure there isn't just a couple of people able to answer this question with the knowledge needed.
That said I'm not saying I'm not saying I'm not grateful for the answers and help just that I'd prefer to be spoken to as an equal and an adult not like a child.. x0 -

despite what you may believe everything I posted was designed to help you in this matter, as I have personal experience of this myself and so understood your initial post better than most
for clarity :- I am a grandad , I have a spine issue and have done so for more than 25 years , I have had an orange badge and now a blue badge for all of that time too, I qualified under the DDA 1995 and then the EA 2010 laws as well as my issues go back to before their introduction
I have suffered discrimination for all of that time and its usually the able-bodied people who do not understand these rules that cause it , like these supermarkets and parking companies etc
therefore I fully understood where you were coming from as regards your nan and it is disgraceful that this happens when an able bodied person like yourself puts themselves out trying to help people like her and me and gets penalised for it , usually due to ignorance by somebody or some company , so yes it makes my blood boil - sorry to say
so if you check my advice so far its all accurate and designed to help you and your nan get out from this crock o ***t that is not of your own making
so I would ask you to appeal each morrisons PE pcn separately using that CM template, also adding a note and attach a scan of the BB and informing them they have broken the EA 2010 too as well as the BPA CoP so to cancel the tickets and put your vehicle reg on a whitelist to avoid future issues

I would also suggest you email the Asda ceo about the smart parking one , mentioning the BB and the EA 2010 act as well , insisting they too cancel the parking charge forthwith otherwise you may have to bring a counter claim under the EA 2010 in a small claims court (carrot and stick) , also to cancel the tickets and put your vehicle reg on a whitelist to avoid future issues
bear in mind my intention here has always been to help you and your nan , but please try to accept that this BB issue varies according to public or private land and dont get the 2 mixed up as it does not help your case
if I park on double yellows on a public road I get the same as your nan , but on private car parks each one is different so dont use the rules of the public road at all , check the signage bearing in mind it does not actually count whereas the EA 2010 does, that is what I always have to bear in mind0 -

Many members, but mostly looking for help and advice, with only a minority able or confident enough to offer a definitive answer.
Also I have to back up Redx. He does come across as blunt at times, as do many of us in the written word. However there have been countless times when I would love to kick some people right up the !!!!. They ask for advice...it's really urgent....only a few days left to appeal... Then sit around for a few days asking more irrelevant questions...what if this, what if that. Then they miss deadlines because they couldn't be arsed. That's after some of us have given up our time to help them and they can't be bothered to help themselves.
