That said I'm not saying I'm not saying I'm not grateful for the answers and help just that I'd prefer to be spoken to as an equal and an adult not like a child.. x
This works both ways Littlemiss!
As part of your recent signup, you clearly agreed to have read and understood the basics of forum navigation - and so forearmed, you should have had no bother in finding the info/introductory stickies and current threads in any forum and not getting lost in the mire of old/outdated threads. Which is something most posters can do without explaining umpteen times a day because it is quite reasonable to assume they don't have to!
So it begs the question - why then do you come on here and behave exactly like an impatient little child, who won't play by the rules themselves?
Now please - Read the Stickies, go back over the info you have been given and start getting things together. You really have been pointed at excellent advice.

Hi again. So i've been into store and have requested that they add me to the whitelist.. So hopefully I won't be getting anymore of these 'Invoices'
RedX I've clicked the link you gave me and found Morrisons but none seem to be appropriate to having displayed a bb or about the ea 2010. I'm ready to send off my appeals but i'm just not sure how to word about the ea 2010 etc..
Thank you everyone for your help so far.0 -

no problem
so I would ask you to appeal each morrisons PE pcn separately using that CM template, also adding a note and attach a scan of the BB and informing them they have broken the EA 2010 too as well as the BPA CoP so to cancel the tickets and put your vehicle reg on a whitelist to avoid future issues
I would ask you to email the Morrisons CEO as well and complain about this mentioning the EA 2010 and her BB too so to cancel the tickets and put your vehicle reg on a whitelist to avoid future issues
once done consider the following
I would also suggest you email the Asda ceo about the smart parking one , mentioning the BB and the EA 2010 act as well , insisting they too cancel the parking charge forthwith otherwise you may have to bring a counter claim under the EA 2010 in a small claims court (carrot and stick) , also to cancel the tickets and put your vehicle reg on a whitelist to avoid future issues
Hi again. I have tried to reply a couple of times, it seems to be posting the reply but when I come back to see if anyone has got back to me they've disappeared again, so I shall try this way instead
I have spoken to Morrisons and have had my vehicle added to a whitelist to avoid getting further invoices like these.. They won't however remove the existing ones
I have clicked the link you gave me, found morrisons on the list but none seem appropriate regarding the bb and ea2010. My appeal is all ready to go except for this little bit of information to add at the end and I'm not sure How I should be wording it..
Also at the bottom of the template appeal letter it says {the registered keeper's name} NO NEED TO USE A REAL SIGNATURE - Could anyone tell me what is meant by no need to use a real signature please.
Thank you all again

People that use forums seem to find them easy to navigate, I have never used a forum in my life and generally hope to never have to many times in the future. All I get is the home page all the time which just seems spammed full of advertisements. Every time I come onto this website it takes me at least 5 minutes just to find how to log in. Just because you may find this an easy task doesn't mean we all do, I appreciate information and help I have been given but insulting me because I don't sit on forums all day and find them easy to navigate isn't helpful to what I've asked.
I have thanked each person that has given me helpful advice as you can see..

Hello redx - even before littlemiss has had a chance to read your post, I want to say 'thankyou' for all you do and especially for post 19; it's a cracker. I'm sure lm will too and you will know each other better now.
lm - my early ?s[only since December] were gauche and £££fear-led[pensioner in all but mind and appearance], despite deep, persistent reading, despite remembering something about these lowlife bandits was on mse. You're still at that early stage where hand-holding feels desperately necessary. You'll quickly grow in confidence, the more you read. Always show your draft letters here before sending them.
As we all know, ppc's deliberately set out to deceive from the recipient's first sight of that pretend 'official' P C N heading. It's made to cow and dupe people, but that won't happen to you now you're here.
redx - like so many others here - is brilliant and expert. In addition we're all human, which is more than can be said of ppc non-sentients.
But don't lose focus. Everyone here will help you - esp. our grand-dad redx:-).
Thank you ampersand and again to RedX

Hi Littlemiss86,
All the advice you have been given is correct - unfortunately private parking companies make up their own rules.
If you want to include the EA 2010 point - I noticed that you raised in one of your earlier posts that " the huge Blue sign that is on that land states that bb holders may park for 3 hours!!!"
But as I understand it you got invoices when you had stayed for under three hours but over two ( which they're claiming was the free time limit)
So because of the confusing terms and conditions displayed you could add to the template letter (which you could include as a point on it's own or as a sub-point to unclear, confusing and non compliant signage) something like :-
"1/ Failure to provide reasonable adjustment under the Equality Act 2010
The driver was accompanying an elderly disabled blue badge holder and parked in a disabled bay. I have since visited the site to check signage and signs at the disabled bays clearly state the time limit for disabled customers is 3 hours.
It's illegal for a service-provider to implement a blanket policy, like an arbitrary time limit, if it has a detrimental effect or causes disadvantage to a person with protected characteristics. A parking charge cannot kick in at the same time - 2 hours - for a disabled (or elderly, or maternity protected) person as it does for a non-Equality Act protected person.
By attempting to levy this charge for a total stay of less than three hours you are failing to comply with the terms and conditions displayed in the disabled bays and by failing to provide reasonable adjustment for a person with a protected characteristic you are contravening the Equality Act 2010."
But make sure you also include the other main points of No Gpeol, no authority, and the signage point already mentioned.0 -

Hi again LittleMiss,
It's advisable just to squiggle a signature - you don't want these guys having your real one - they can be far too tricksy0 -

Many of us like to send a snail mail copy too, ALWAYS obtaining a free Certificate of Posting from the PO.
NEVER send it Registered Delivery - that gives them an excuse to refuse it.
I see you've been up at silly clocks worritin' over this again - PLEASE DON'T.
There is no need.
Just walk in the footsteps of thousands of others before you here, not suddenly fearing because you don't find the EXACT mirror fit of your circs.
It's the points of law that carry the day, every time.
You know how to do this, because they're set out for you to use, in the template letters.
This is what any POPLA assessor would look at - IF THINGS GO THAT FAR - only this, not mitigation, although that could go on a supplementary sheet if you felt better for it.
Post up your final draft, so we can be sure it incorporates those points CC reminded you of.
And remember, THEY ARE NOT 'FINES'.
They are UNENFORCEABLE INVOICES or DEMANDS FOR MONEY.
If I send you one, will you pay me please?:D
-and DON'T let Morrison's off the hook so easily.
Phone this no.01274 261000. [Morrison's CEO]
Go as high up the chain as you can. USE IT to express your disbelief that this should happen blahblah. You were appalled that a Morrison's manager had no interest in retaining your business etc.etc.
Morrison's CEO email is: dalton.philips@morrisonsplc.co.uk
Alert them to look out for your email and/or snail mail copy, 'en route today'. You expect a full reply within 10 working days. Be careful to include both 'parking event' no's.
- You expect cancellation of these 'invoices' by return and a full point-by-point answer, not a generic acknowledgment.
- you have proof of shopping available. [Emphasise this will end when they lose your business: everyone can play the threats game, empty or otherwise]
- Do Morrison's wish to publicise their Faustian pact with a ppc which targets Blue Badge holders?
Now, take heart and don't be sidetracked.
ONLY when you've done your homework
