Apologies for the new thread. I've searched through many threads on the forum about action on parking fines & much of the info is not easily navigated, convoluted or has links to various other cases, relevant or not.
I received two UKPC parking fines over the Xmas period. I reside in England. The vehicle is company-owned & not registered in my name.
I've ignored all letters to date based on information I originally searched for on this forum but understand laws & process may now have changed?
I(we) now have two 'notice of intended court action' from DR+. Both for the value of £160.
Unsure how 'popla' fits into all this and how they may help, or even if that ship has already sailed. Any help on what I should/shouldn't do next greatly appreciated.
Thanks

Okay who are they writing to? Is it your company or you directly? The reason is that potentially your company could be liable as the registered keeper. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

They're writing to the company I work for.0

Please read post #4 of the sticky NEWBIES thread - DR+ are a debt collector0

Incorrect! - The forum is standard Vbulletin - and thus extremely logical and straightforward to navigate.
You also agreed to have read and understood the basics of forum navigation as part of your signup, so this should be very fresh in your mind.
The very first thing you need to do is read the stickies - particularly this one:

Many thanks for your condescending response0

Many Thanks. I'll look into it.0 -
You may be able to name yourself as the driver for both of these and get the clock re-set so that new notices will be sent to you, which you can then appeal to get POPLA codes so that you can then appeal to POPLA.
Were either of these windscreen tickets? If no then I think you will be able to do what I said above. But hang fire until someone more knowledgeable confirms my understanding
Will need to appeal both separately0 -
You need to ask your company to name you as the driver, this will discharge their liability and resets the clock. Ask them to write to both the parking company and DR+ , this will enable you to deal with this, unless this was a windscreen ticket?
I don't know why you have been ignoring this, by doing so you could land up paying if your company caves, because faced with a small claim even a threat of one means they could cave. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. Extract from the NEWBIES thread below
DEBT COLLECTOR STAGE - SEE SEPARATE POST #4 BELOW
TOO LATE TO APPEAL - YOU THINK?
YOU CAN STILL BE PROACTIVE AND GET THESE CANCELLED, OR AT LEAST MAKE AN INFORMED DECISION TO IGNORE ALL EXCEPT COURT PAPERS.
Are you the keeper but not the driver? Left it too late to appeal, but so far only had letters (i.e. not windscreen ticket cases)?
You can write to the PPC at any stage before (very rare except with ParkingEye!) court action, to give the name and address of the driver and under POFA 2012 that then discharges any possible liability against you as keeper.
This is especially recommended where it was a postal PCN BUT the keeper has ignored it and missed the appeal window - but the driver will never yet have had the 'chance' to appeal due to the lack of a windscreen ticket. A good plan is to give a different postal address for the driver, and state that you have NOT passed the paperwork to them so the PPC will have to write to the driver with a Notice from scratch.0 -
You do realise the company 'could' be held liable under POFA 2012 so they should be naming you as driver anyway so that you get the letters and you can ignore it all? You are technically too late to appeal so you can follow the advice in the NEWBIES thread about your options when 'too late to appeal' and the post #6 in the same sticky, telling you about debt collector letters (drivel). Better to get the letters yourself, rather than worry that your company might get shirty and pay it and deduct the charge from your wages or summat.
You are up against a PPC which doesn't do Court but it's best for your company to name you as driver which is what they should have done really (name and address). Then you should keep all the letters just in case but with UKPC I wouldn't worry about it nor respond at this late stage. As long as it is UKPC and not UKCPS!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
