I wouldn't advise using the FOS, they are useless, having had experience with them in the past with an unrelated matter.
Legal action gets straight to the point with no faffing about and I don't want to faff about with Erudio.
I earn below the threshold and I "showed" that to them yet they refused me deferment.

Thanks Edwood. I wonder if Erudio will make any representation. I guess they might string it out for the maximum to avoid a decision (where they were present) against them. Is there a time limit after which the judgement can not be contested?

Oh just the thought of this makes me happy. I am thinking of that tv programme where they send the enforcement officers in to see if there is anything on the premises that is of value for them to take! Knowing Erudio though, nothing is owned by them anyway!

Just received Notice of Termination letter. Dated 22nd but only arrived today.
Got 7 days from date of letter to pay the full amount of over £11k. Not happening obviously.0 -
Idle threat I presume? If they terminate the agreement when your obligations have been met they really would be in deep !!!!!Paying for uni to get a job... just to get a job to pay for uni0

I'll find out soon enough I suppose.
Though the letter does state "in accordance with condition 9 of your agreements and condition 5.2, terminated your agreements. As a consequence, your contractual rights have been terminated"
Apparently my account will now be reviewed to determine whether to pass it to a DCA.
Will be sending a letter tomorrow, simple saying I've sent recorded evidence every year (bullet list of dates when I sent the letters), to show to a court if necessary I have met my obligations and done everything I could to defer. It's going to be addressed to Mr Burns (operations manager) as that's the one who has sent the letter so he might as well get the response.0 -
If there is no court order against you, then tell any "debt collector" that they are not welcome. Send them notices to keep away from your home and property. Explicitly remove from them any implied rights of access to your door or property, and inform them that any further contact will be regarded as harassment.
I expect I'll be getting a 'Notice of Termination' or whatever, in a couple of weeks.0 -
I just checked to see if my letter was signed for... it was, by K. Moffat, at Erudio's Camberley PO Box, June 15th. Got the image of signature on file.
I sent this:
"Dear Erudio Operations Manager and Erudio Student Loans Limited,
my account should not be in arrears because you were provided with the necessary documents, wage reports, and co-operation in November 2014, when I applied to you for deferment.
You have breached the contract by not granting deferment. You should amend your records and remove the arrears, before you misrepresent me to a third party, either deliberately or inadvertently.
You have acknowledged receipt of my wage reports, which I sent in correspondence with your company, the most recent being mid September 2015.
Thankyou for the Annual Statements, I believe there was some problem with Student Loans Company Limited failing to provide complete Statutory Notices, (I have some of these notices), is this true? You haven't explained what the problem is, nor have you shown how you have corrected it.
Your actions have caused me considerable distress, and losses. I have so far spent at least xx hours dealing with the consequences of your maladministration, which does not include loss of sleep.
I demand remedy. "

I didn't send wage reports because a year (or ten months if you like) hasn't passed since they had the previous lot. Erudio hasn't sent me a Deferment form since the end of 2014 incidentally.0
