    Remedy of Account:

    At the end of May, I got a fat envelope with a covering letter dated May 23rd.

    The letter states that under the Consumer Credit Act,
    "lenders are required to send statutory notices to their customers to inform them of the status of their account"...

    ..."As part of the transfer of your account, we undertook a large project to rectify an issue with some of the statutory notices that SLC had previously sent. This has taken several months to complete due to its scale and complexity.
    Now that issue has been resolved, we have been able to produce the statutory notice(s) that should have been sent to you since 1st March 2014."

    I thought I had read somewhere that a notice of account should be sent within 28 days of request...I recall requesting one for my account in November 2014, but that is an aside, and could be incorrect.

    Also in the envelope were two annual statements dated
    01 Sep 2014, and
    01 Sep 2015.

    There was a quasi pattern of adding interest then rebating twice as much each month... amongst their Direct Debit thefts, and my bank refunds.

    Further into the envelope were three Notices of "Sums in Arrears", backdated as
    28 Dec 2014,
    28 Jun 2015, and
    28 Dec 2015.

    They state that my account currently has arrears of £577+.

    About 10 days later I got a letter dated 04/06/2016: "Notice of Default".

    ..."In order to remedy the breach, you must pay the arrears amount due of £614+ by 02/07/2016".

    It (the Erudio) proceeds to inform me of what they "may" do, and what this "will" mean...

    full balance payable immediately...legal proceedings in court...rights terminated...no deferment...no right to age cancellation...
    may register default ...with Credit Reference Agencies
    " please note....result in difficulty obtaining credit..." ( I can't express how aware I am of where the chestnuts are).


    This all follows Erudio refusing to accept my deferment because I wouldn't consent to their demands for new consents etcetera.

    Interesting that they will not elaborate on what these issues are and that we are expected to take their word that they have been resolved. Their word cannot be trusted so as far as I am concerned, this matter is not resolved.

    For the record, I am keen on getting a decision in court about Erudio not granting deferment when they have been given evidence of income. So I'm happy to get involved in plans for such a thing.

    I feel this is important because I have noticed other 'documents' which conflate acceptance of terms and conditions with applications for state benefits, council tax 'relief', etcetera.

    I have avoided claiming such 'benefits', even though I clearly qualified for them, because of these devices. Of course Government can change statutes with the stroke of a pen, but sometimes their schemes get ruled unlawful and they need consent. Workfare springs to mind, and TTIP is looming.

    So I'm interested in a group action, or small claims court.

    In my current position I will send some more wage reports and demand that Erudio remove arrears. If they start adding charges for attempted collection, then I think I should go straight to small claims.

    I took a quick look at small claims prices and figured maybe £300 costs, but can anyone give me a maximum cost for a small claim action?
    Any better ideas?
  • Personally, I would not send them any more wage slips or indeed anything else related to your income etc as its none of their f$+(ing business. You have met your obligations under the terms and conditions and they are in breach of contract by not authorising your deferment.

    Have Erudio changed their paperwork address? It used to be a PO Box in Rotherham, but now seems to be a PO Box in Camberley. Is that right?
