The sending forms part probably just refers to the SLC ones.

Rizla, do you have a link to where Erudio have stated that DD setup is not necessary? I could do with saving it for future reference, just in case.
Also, their letter definitely states they want to send one of their own deferment forms - it's going straight in the bin though!meh...0 -

The new form will still feature a Direct Debit Mandate request, however, this will be optional rather than compulsory. Please note that if the deferment application is unsuccessful, we think it is still best for customers to complete this to ensure they can make a repayment and thus protect themselves from their account going into arrears.Still rolling rolling rolling......<

Background - 2 loans in 99. wayyy below deferment. refused to sign DAF. Final response from Erudio says I need to sign. In arrears. 2nd complaint with FOS.
FOS say they are only able to look at my claim that signing changes my t&cs and said they won't take into account the fact that Erudio have deferred some without signing :-/
Looked back at the response from ESL about my first complaint (signing the DAF) and they had the cheek to quote the 97 regulations (regarding the need to 'satisify' the loan administrator) and say the 98 regulations ('show' evidence of income) does not specify the method of deferment, and so completely discounts it! Unbelievable!
I've sent the FOS the copy of my original loan agreement sent to me by Erudio, totally illegible.
Anyway, does anyone have a succinct way of stating how my t&c's are changed? Erudio say that by signing the DAF I will not be automatically consenting to the FPN which related to reporting to CRAs and I can withhold consent but this isn't true is it?

I must inform you of the consequences of being in arrears which may lead to the following:
· Calls and letters
· Further administration charges
· The account being terminated which leads to the loss of right to defer and the cancellation of any age and time related loan closure dates
· The account being passed to an external debt collector
· Outstanding arrears could impact your credit file

Not saying people should sign the form, but if you don't you obviously have to be prepared to take the fight all the way, build up arrears for now, and possibly take the route of legal action.

As you're on the post-98 agreement, Erudio can only report your loans if you default on repayment, unless you consent to them doing otherwise. It's completely bizarre that FOS can't see that you're effectively being coerced into a change in terms, by submitting the DAF, it says as much in black and white. I would ask both FOS and Erudio where the option is on the DAF to withhold consent - if it was true that consent's optional, there would be a check box of some sort, making it very clear that you are agreeing to a detrimental change in terms and conditions, and that you're consenting to your deferred loans being reported, when they're currently only reported if you default.
Saying consent is optional implies choice, but there's no way to make your choice on Erudio's DAF. At least you've made your "choice" clear to them, but you shouldn't have to raise 2 FOS complaints in order to do it!!0 -
Erudio emailed me back today regarding my enquiry as to whether or not they'd received my DAF and, if so, what my status was:
Dear Mr *****,
Thanks for your email.
I am sorry that you have not heard from us about your deferment status.
I am delighted to confirm that your deferment application has already been accepted. Your deferment period runs from ** ****** 2015 to ** ***** 2016. A confirmation letter with more details will be posted on ** ****** 2015 and you should receive it within 3-5 working days from this date. If you do not receive it, please do not hesitate to contact us.
We cannot send the confirmation letter before that date as your new deferment has not been actioned yet on the system.
You shall also receive a new deferment application form 8 weeks prior to the deferment end date (**/**/2015).
I trust this is satisfactory.

Good to see they're 'delighted' to be confirming people's deferment
Also, the contact number they've provided (03330037188), if I'm not mistaken numbers beginning 033 are charged at the standard rate for UK landlines, as opposed to premium rate numbers. I haven't got the original letter they sent me at hand, but I'm sure it gave an 0845 number - or something similar. I'd still shy away from telephoning instead of writing a letter or an email, but it's good to know that those who have to speak to them in a hurry won't be stung by premium rate phone charges.
For those who've been discussing whether or not to send in bank statements: I didn't send any in and just enclosed copies of my latest three payslips, last year's P60, my Housing Benefit award letter and also my Council Tax statement. Plus, as it was the old-style DAF, I crossed out the Direct Debit Mandate.
Oh and there is no gap in between the end date of my current deferment period and that start of the new one, so no room for any sneaky arrears to be applied to my account.

Have you heard the "We don't seem to be able to find the scan of the letter that you say we've signed for" one yet? That's hilarious too. My personal favourite is the "We don't seem to be able to open that particular attachment to that email". Although it isn't as funny the second time you hear it....
How long did most people have to wait for a final response from their adjudicator from FOS?And I find that looking back at you gives a better view, a better view...0
