I didn't get all that from your previous post.

In that case, it's 3 months' payslips, that was SLC's requirement. So payslip for the month before applying for deferment, as well as the two months prior to that, which although not strictly a requirement of the regs, I guess was requested to support the declaration that income's unlikely to go over the threshold.

Sorry, I should have been clearer, my fault.

I think I'll wait for the 3 payslips and then apply, although technically I think I could do it now. I might ask for the deferment pack now though as it will probably take weeks to arrive.

Don't suppose you've changed jobs Lungboy, or gone onto new contract with your current employer? A copy of the new employment contract plus one payslip's all that's needed then.

If i sent them.my p60 it would show my true wage on It. Which is over seven grand less than the deferment level.
Hmmmmm I'm wondering now. I've just paid my arrears and asked for a receipt which is yet to be appearing.

My new contract was 7 months ago, but for 6 months I kept a higher wage due to being redeployed within the same company. Now my wage has dropped to its proper level, but I only have feb's payslip showing my proper wage.

Do you have any paperwork from your employer confirming that? If so, you could just submit that, plus your Feb payslip? They're not going to defer you without the DAF anyway, so while that fight's ongoing, you'll then have extra payslips to prove you're still under the threshold - worth a try if it means two less payments to Erudio :)

@ globetrotter123 It's in the terms of the agreement that you must provide your new address - if you're abroad, not sure if that would be your overseas address or a contact address in the U.K.?

Did you agree with SLC that the deferment pack would be emailed (and if so, do you have evidence of that)? How soon after deferment ended did you chase SLC/Erudio? If you can show that the delay in deferment was down to SLC and/or Erudio, then you would have grounds to take it to FOS to try and get the arrears removed.

The problem might be that Erudio could say they sent a deferment pack, arrears notices, etc to your old address, as that's the most recent address they have for you, and you can't prove they didn't as you don't live there anymore!

Hmmm, not sure that I do. I'll have a read of my contract.

I have finally got erudio to acknowledge that I am in deferment after many, many emails....however they are sticking to the fact that I am in arrears of £1k+ ... and that they can only backdate for 3 months (a few hundred £) I went into arrears apparently early this year. no acknowledgement from them to say I was going into arrears....anyhow, they now say they can only backdate the arrears 3 months....so, is this right??

Correct. If the arrears are their fault for delaying your deferment, then they can and must backdate more than the 3 months.

They backdated more than several months of arrears on my account as they accepted (I'm assuming that by default as they haven't actually confirmed that in writing) it was their fault that I couldn't defer.

Had my response from FOS - no great surprise to any of you that Erudio can do whatever they like regarding CRA reporting. My adjudicator "does not believe that payment holidays will have a negative impact on my credit file as it will show other creditors that my loans are in deferment."

Can someone with more knowledge of how credit ratings/files actually work comment on this please? I can't see how having up to 36 months of payment holidays can do anything other than look like I can't afford to repay them.

Would banks allow up to 3 years worth of payment holidays on mortgages or "proper loans" (IYKWIM :D)?

She has not addressed by question of how this 3 year period fits in with Erudio's latest flannel about payment holidays being temporary.

She's also not commented on the fact that there is still a lot of outstanding paperwork. She is happy that Erudio say they've sent it to me.... 5 times I've requested a statement in writing, yet I still don't have any idea what IR they're charging me (I know what they should be charging me, but...). Is it just good enough that Erudio keep saying "We've sent it" even though I never receive it - it would appear so.

Not amazingly impressed with FOS, but not surprised either.

She did agree that they'd failed by not sending large print documents & there was no way they could wriggle out of that one as she had copies of everything. So I am due some compensation, but I don't know that I want to settle just now. Will have to mull it over.

Has anyone actually received a penny's compensation yet? Have they just taken it off the loan balance :rotfl:

In her/FOS's defence she has explained her reasoning very well & I can follow her arguments, even if I don't agree. So she's clearly one of the better ones :D

For me, it probably won't make a flying **** of a actual difference to me in real life if my credit file is trashed, since I doubt I'll ever be applying for a new mortgage/loan/card ever again, but that isn't really the point, is it?

Grr - another f'in weekend spent getting cross about f'in Erudio....
And I find that looking back at you gives a better view, a better view...

Well the senior manager has obviously taken leave of her senses and upheld that they do not assess the calculations of income as it is not part of their job. Because erudio have stated they have followed procedure they have agreed with thEm. Well pass it onto an independent assessor then. I'm !!!!ed off to say the least.

I "believe" the adjudicator is talking bollhocks. ;)
