  • Hello everyone, and Happy New Year.
    I'm a little perplexed about the predicament I find myself in and don't really know what my rights are being in this situation.
    I purchased a box of Lego on an ebay auction on the 23rd of December 2020.  I payed the seller immediately and as postage I requested it be shipped using the click and collect service to my local supermarket, knowing what certain delivery companies can be like.

    On the 28th December I contacted the seller and asked if the goods had been shipped as the status still hadn't been marked as dispatched.  They immediately responded with a photo of the parcel having been delivered to the store's warehouse and not to the garage where all click and collect parcels should be delivered.  Later on the 28th the tracking marked the parcel as back out for delivery.

    On the 31st the tracking updated to show the parcel should be delivered on this day between 14:00 and 17:00 and between 10:00 and 13:00.  Needless to say something a little screwy was going on.   I watched the tracking all day and at 6pm the tracking updated again to say the parcel had been delivered at 10:53 and again to the store's warehouse.  I called the store immediately and spoke to the staff in the garage and explained the situration, to which he went to the warehouse to check for the parcel.  He and a collegue couldn't find the parcel.  

    On New Years Day I went to the store and spoke to customer services who again went to the warehouse to check for the parcel and again couldn't find it.  I was asked to contact the store manager on the 2nd.   I spoke to the store manager twice on the saturday and he said he would check the CCTV footage of the warehouse to see when it was delivered and who might have moved it.  When I spoke to him again at 3pm he said that there was nothing recorded at the time the package was supposed to be delivered and the parcel isn't there.  He told me he would check the rest of the day, and I am still waiting for an update.

    As the parcel had not been delivered according to ebay I raised a complaint and requested a refund, and as expected the seller is being less than helpful.  They have suggested they are going to talk to Hermes but I doubt they have.  I have asked for documentary proof that they used the collect+ service and that is yet to be forth coming.

    I have also raised a support case with Hermes and am waiting for them to contact me back.

    What I don't know is what my rights are in this situation?  I don't know if the seller shipped the parcel correctly for click and collect, and as the Hermes driver has dropped it in the warehouse and taken a photo as proof of delivery, but not used the ECP number?
    Any help please, is greatly appreciated, thank you.
  • Hi all, I got an IKEA Christmas tree after hearing about the £20 voucher you got with the deal - effectively making the tree £9. But now stores are closed, and the voucher doesn't seem to be able to be used online! The voucher will expire before lockdown ends. Has anyone else got this problem? I'd still like to be able to spend the voucher, and only went for the Christmas tree deal because of the voucher! 
  • My son who lives abroad payed £1000 to hire a car last year to come and visit me but due to covid had to cancel the car and get a voucher for this year. Again due to covid and only being able to come in March due to work he has tried e mailing the car hire company to get his money back but is not getting any reply. He has taken it up with American Express who he booked it with but they say it's between him and the car hire.  It's a lot of money to lose so if anyone can give me some advice I would be grateful.

    i have left a very expensive ring for repair in a jewellers which has remained closed for lockdown. My question is what happens if at any time their business collapses? How do I ensure I get my ring back?

    Unable to find anything regarding UK rights so thanks in advance to anyone who can keep me right 👍🏻

    Four years ago we had our windows replaced by an offshoot of Penicuik Home Improvements. They were, frankly, an awful company to deal with so it doesn't surprise me to discover today that they went into administration a couple of years later. 
    We had a 10 year warranty on our windows and one of them is now allowing water to penetrate around the frame. Am I right in thinking that the credit provider has some responsibility for this? How do I go about chasing it up?

    Contract assistance, please. 
    In 2019 as a business was trying to make some advertisement, been approached by a company person to visit our office and propose advertising in 2 local GP surgeries (appointment leaflets).
    At my best communication, we agreed to this high traffic surgeries 2yrs advertisement plan with the partial payment. With the hit of Covid-19 on 2020 surgeries were not issuing those appointment cards and switching to phone messages services. 
    Well as a business, we agreed on this lost money. although the other terms of the contract were also not met.
    We got over this and accepted this as a bad investment. Although the service supplier has not, and is pushing us in all the ways to respond to the contract and keep paying until the end of the notice period (not yet given).
    I would like to ask if someone can suggest to me on what I can rightfully ask Supplier (1) and (2) Does the COVID count as the unforeseen force major.

    @6liuxa, did you notice that this board is the Consumer Rights board?

    As a business I guess your query isn't that of a consumer.
    Perhaps your query would be better place on the Small Business board - assuming of course that your business is small.

    Please can anyone help with advice.  I have a iPad Air 3rd gen.  the other night I was using in and a crack appeared on the screen as I pressed the home button. I took it to Apple who agree it’s a stress break and if I had brought from them they would of replaced it.   They then said but because I brought it from Currys I will have to fight with them.   I headed to curry’s they said it was accidental damage agfter I argued that it wasn’t they said take back to Apple.  I said no you have to sort but they would not budge as said out of warranty I brought it October 2019.   What is my next step complain on the phone email or Twitter
