I presume they would have taken pics of the upside down ticket, it has a serial number on the back as well as they front and they will both tally up with my pictures

Will have a go writing it out later, cheers

Is it ok to appeal now, i really cant wait up to 58 days for a notice to arrive, i have my dad very ill and other things going on right now and can really do without the extra worry on top of everything else , cheers

    Deanos,

As has been said by others, you can appeal earlier as keeper. But bear in mind another good reason for following the long process of ignoring the windscreen invoice and waiting for the NtK is because it gives the PPC far more opportunities to make mistakes: Mistakes with timing of letters, wording of letters, compliance with PoFA, etc. etc.

Pessimists see a glass half empty :(
Engineers just see a glass twice the size it needed to be :D

first , some pedantic comments on wording , for clarity
    this action must of
    is must have

I wouldnt bother with signage as yet as it may have rules stating the ticket must be in the windscreen area and the correct way round etc

dont drop yourself in it at this stage, its cancel or popla code time at the moment

otherwise its good to go in my opinion

if you end up posting it, get a free certificate of posting at the post office and keep a copy of the appeal etc yourself too , keeping the certificate as well (do not send recorded delivery)

personally, I would wait for the NTK

I wouldn't admit that the ticket turned over, just say that when you left the pay and display ticket was correctly placed. Don't help them with reasons to turn your appeal down.
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

I would add something to the end of the first part along the lines of:

"As you acknowledge that a ticket was on display, and I have shown that a ticket was paid for, neither you or the landowner has suffered any loss in relation to this matter. As such this invoice has no grounding in law."

OP - use the letter as keeper as per coupon's statement.

Smart Parking do not follow POFA and keeper liability as their notices are not compliant so can only pursue the driver if known.

Be non-committal and state that a ticket was found in the car proving purchase on the day therefore there was no loss incurred to either Smart or the landowner - if you have the ticket -SEND A COPY only.

A bit pedantic, but don't forget things like capital letters etc, good grammar costs nothing.

Its a big shopping centre with many retailers, not sure the wife even used any of the shops , parked there and walked into the city, will ask her later , cheers
Don't tell them that, or they may also try and charge you for that too!

Either way, they do not have the right to invoice you for £40 (or £70) because the ticket was upside down; you paid the requested amount on buying the ticket, and that's all they were entitled to.

Use all means recommended here to cost them money.

its only hard work because you want to rush it and because you want to keep explaining yourself and therefore "dropping yourself in it"

stick to the template, mention the ticket was correctly displayed when leaving the vehicle and no loss was suffered as the ticket was paid for and valid , add a scan of the valid ticket , and send , dont try to be too clever or elaborate , and definitely dont hand them their case on a plate

even better, wait for the NTK and then appeal is what I would do , using the above info
