PCN for upside down ticket

Sorry i have searched and cant find anything similar

The wife returned to the car to receive a PCN from Ltd, £80 or £40 if paid within 14 days

The parking ticket which was bought was displayed correctly but must have turned over when the car door was shut, its of the non sticky variety, so the text etc was facing downwards

Contravention: No Valid Ticket
Remark: ticket upside down

The ticket has a serial number front and back and i presume the officer took a picture ? so would prove we had a valid ticket



I wish to appeal but not sure what to write

The contravention could maybe a get out as she did have a valid ticket, i presume the PCN should say "ticket not displayed correctly" or something similar ?

    Please read the sticky Newbies thread. You situation is no different to any others, if there is a term that the ticket be displayed in a certain way then they are claiming that you failed to comply, in the same way as if you had overstayed, parked outside of a bay or any other breach.

    Providing you are the registered keep (i.e. not a company or hire car) and this happened in either England or Wales then ignore the windscreen ticket and wait for the letter through the post. This will arrive between 29 and 58 days from the date of the ticket on the windscreen. In the meantime familiarise yourself with the sticky thread and the appeal steps and templates.

    thanks, yes i did read the sticky before i posted but there is so much information to take in , im not the best person to absorb information and it all becomes confusing, i have read it twice now and will have another read

    i cant see anything about the charge increasing if not paid, if i wait for them to contact me would the invoice go up to £70 ? just thinking if i loose an appeal the cost has increased

    this is how they try to entrap you into paying early , it doesnt go up , they say it comes down if you pay early , trying to entice you to pay

    the best way out is to stand your ground , appeal the NTK and if necessary beat them at popla

    the fact is that the landowner suffered no loss, so no money is due, nada , zilch

    if they had a rule saying no pink coats on your back seat and ticketed you for it , would you pay it ?

    pay them in full asap with monopoly money, thats all PPCs are fit for
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Is it ok to appeal now, i really cant wait up to 58 days for a notice to arrive, i have my dad very ill and other things going on right now and can really do without the extra worry on top of everything else , cheers

    You can appeal now if you wish, as other things are in your life rather than the poxy fake ticket from Smart. Just use the template letter in coupon's sticky thread. I suggest not adding your address to the letter, telling them to go and pay the dvla for this data after day 28 of ticketing.

    Send it online and through the post if you wish, but get a free proof of postage from the post office, don't send recorded.

    Try not to worry about this, Smart are a toothless company who never do court, and only send threats to do so. Hope your dad gets better soon.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Much easier/quicker option that may work, go see the shop manager where you parked show them the ticket and tell them to have it cancelled.

    Its a big shopping centre with many retailers,not sure the wife even used any of the shops , parked there and walked into the city, will ask her later , cheers

    If it's a big shopping centre it may be that there is a centre manager. If there's an information desk then ask there. They don't have to know whether you bought anything or not, unless you tell them.

    Whilst I see what Storma is saying, Smart Parking insist on you providing an address. If you don't follow their appeal route rules then they will just reject your appeal. But because you haven't told them where to send the rejection you therefore have not identified the driver. They will therefore be within their rights to issue a notice to keeper anyway. And when they do the the DVLA check and notice the name of the registered keeper is the same as the person who appealed the notice to driver you will have essentially identified yourself as the driver. They can then send you the appeal rejection letter, by the time it gets to you the POPLA code may have expired. Their defence would be that it was your own obstructive behaviour and non-compliance with the rules of their appeal procedure which caused the delay.

    I know waiting is a pain but it really is the best option. Also you might be one of the lucky ones who never hears from them.
