TNC sent NTK but states cannot appeal???

    As we often see now they are pretending it's a contractual fee but then they also use the word 'contravening' which shows it is in fact a charge for an alleged breach of contract. That's good as they have to show a GPEOL (see the NEWBIES thread for acronyms and also for 'How to win at POPLA'). Show us your draft POPLA appeal once you have searched & found a few, or looked at the ones linked in the NEWBIES thread.

    Would GPEOL stand as it states: 'your vehicle may also be issued....' also being the keyword - as on top of this it states: binding contractual agreement??

    The car was parked in front of the house that it is registered (house of registered keeper) - after shopping unloaded, car was left with a valid permit which must have slipped away - is this worth mentioning.

    update - response from P4 Parking:

    Dear XXX,

    In response to your letter corespondence the parking charge notice isued to your car is legal you have lodge a appeal and was an insuccesful so theirfor the matter is now with our dept collectin services TNC with is a legal organisation and we will be instructing them to continue to persue for outstunding parking charge notice. P4Parking will not be responding to any tharther corespondence regarding this mater, if you wish to challenge tis action then you are liberty to do so.

    Please be informed that this is our final decision.

    I have deliberately left all the mistakes in the email received - its a really poor email sent by P4. I think I should be able to use this email to build my case of incompetence and harassment :-)

    Update: have sent Steve at BPA all the necessary documents for investigation. The response I received:

    It is obvious that this company could not arrange a proverbial in a brewery. Is it not time to stop treating them seriously?

    What is the worse that can happen if you ignore them, they threaten to add more costs to their invoice, big deal.

    Let us look at this dispassionately. A gang of knuckle dragging ex-clampers sent you an invoice for £100 for parking outside you flat. Why? Because they think that they can con you into believing that they have a contract and that a judge will award them money for your breach of that contract.

    Do they have a contract? Were the signs adequate, have they complied with POFA, court procedures, do they have permission from the Landowner to take you to court, has anyone lost any money?

    If they fail to convince a judge that they can satisfy any of above, they lose, and you can counter claim for them disturbing your quiet enjoyment of your property as required by your lease.

    Call their bluff, tell them to put up or shut up, enough is enough.
    You never know how far you can go until you go too far.

    What a terrible email - make sure the BPA sort this out & get a POPLA code or cancellation. This AOS member is an embarrassment to the BPA with an email like that.

    Guys, I'm I going about it the right way by pursuing TNC for POPLA code?

    Or should I try and re-initiate comms with P4 Parking? I am still awaiting on BPA to get back to me.

    TNC are debt collectors - yes? As such they have no status in this process other than as toothless debt collectors.

    Any appeals and POPLA process should be via the parking company - P4Parking in this case.

    (Unless I'm misinterpreting something?)

    Write to P4Parking not TNC, and say you've reported them to the BPA for denying you a POPLA code - as a registered keeper who appealed straight away - so you expect them to send you one before the BPA get in touch with them. Same as all the other P4Parking (and similar JAS/Staples) threads on here, easily found with a search:

    Guys, need your help - I was given a back dated letter which I received 3rd of March - it was dated 13th Feb - I responded straight away to TNC and P4 Parking - but now they are saying that I do not qualify for appeal as I missed the 28 days period. This is the last email I have received from P4 Parking:



    Dear XXXXX XXXXXX,

    Our department have received your correspondence and informs you that due to the 28 days expiry period you have lost the right to lodge an appeal.

    Please be informed that this is our final decision.

    Please do not reply to this message via e-mail. This address cannot help with questions or requests.
