TNC sent NTK but states cannot appeal???

    Did you go and make complaints to Steve Clark at the bpa? I would be inclined send a letter before claim for harassment to these morons. They have no legal cause to pursue the registered keeper
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    sent a second email to Steve Clark - I have not yet received a response from the first email - only AOS@BPA responded.

    Should I send another letter to TNC requesting POPLA?

    Sent Steve two emails - 2nd one just fired away now. No response from Steve directly. TNC seem to just ignore my letters?!?!?

    Well to be honest that's what you should be doing with TNC, they are just useless scammers who don't and can't do court. But if it was me doing this I would be sending threatograms back to them.

    A letter before claim to their registered address for say £300 for harassment may help, especially if you send an unstamped small claim form with particulars of claim filled out, with a threat that you will go to mcol with it.

    Depends how you want to handle this, militant or ignore, I don't obviously recommend paying the scum

    Have you pointed that out to the BPA after their dismissive response previously?

    update: today I received another letter - heading: 'Outstanding Parking Enforcement Notice' - the lying toe bags sent this letter dated 06 March - where I received a letter yesterday dating 11th March??

    This letter is again threatening litigation.

    I am going militant and will take them to court for harassment. I have proof of delivery of the letters I sent requesting POPLA.

    Can I trouble someone to help me word the harassment suit - I want to send the letter tomorrow.

    If you are serious about pursuing the harassment angle then the first thing you need to do is send them a letter before claim. There are certain formalities you need to include, for example, the reason you're bringing the claim (i.e. breach of the Protection from Harassment Act), the remedy you seek from them (financial etc) and the time they have to respond (28 days is the usual). You need to do this to comply with the pre-action protocols.

    On a personal note, I would be very cautious in taking this matter to court. But at the end of the day it's your money and your decision. At the very least it might be an interesting test case.

    Just forward the latest letter by email again to Steve Clark to add to his investigation and say this is harassment by a BPA member now.

    You mean you've got a POPLA code now?

    You should find plenty of POPLA appeals about this lot as I recall seeing them in recent months - search this forum for the word 'P4Parking' (ONE WORD).

    As we often see now they are pretending it's a contractual fee but then they also use the word 'contravening' which shows it is in fact a charge for an alleged breach of contract. That's good as they have to show a GPEOL (see the NEWBIES thread for acronyms and also for 'How to win at POPLA'). Show us your draft POPLA appeal once you have searched & found a few, or looked at the ones linked in the NEWBIES thread.
