TNC sent NTK but states cannot appeal???

Hi,

I really need your help everyone. I have read the forums but I am stuck. I received a private PCN outside my flat (private estate) just done some shopping.

It states that I cannot appeal to TNC??? What do I do?

    What you mean they say you can't appeal? Can you post up a redacted scan of it, just use tinypic and remove the http://www part of it to do that.

    No P4 Nighthawk did not write to me at all apart from PCN on windscreen. First letter received from them.
  • There is an error here - as the link is not working now.

    However, from other threads recently TNC Parking services act as back offices for some other small PPCs and they do send out non-compliant NtK's from others seen - asking for appeals within 14 days and naming the driver.

    One other NtK seen actually could not add up the amounts!

    Appeal via the online portal as the registered keeper and request a POPLA code - use the template version in NEWBIE thread.

  • It is an extremely poorly worded notice to keeper trying to pretend it is not. They have accessed DVLA information and they are part of BPA so they haven't got a leg to stand on. I would appeal as keeper, pointing out that you refuse liability as it is not a compliant notice and you will not be identifying the driver. Send a copy of this notice with a complaint to BPA and the DVLA. I'm sure wiser heads will help identify the exact wording, but treat it as a ntk and follow the sticky guidance.

    Just follow the NEWBIES thread and send the first appeal letter anyway, to TNC and to P4Parking. Ideally, IMHO you should not have waited for the NTK or this lot, I do specifically name them in the NEWBIES thread as one to appeal (as keeper) when the windscreen ticket is first received. You now have more work ahead of you to get a POPLA code out of this lot, including a complaint to the BPA needed I suspect.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    There appears to be a bit more to this, as TNC are acting as enforcement agents, and are under no obligation to hear your appeal. It would appear that the actual Parking Charge Notice was issued by P4 Parking (who also trade as P4 Nighthawk). You mention that you received a ticket on your windscreen. Whilst most companies will then send a postal reminder they are under no obligation to do so, and unfortunately some don't. I would still appeal to Nighthawk, you could maybe claim that you received no notice, but this would mean telling a slight porky pie that you did not see the ticket on your windscreen.
