I think this is complete !!!!!!!!. I've already said that in my case, I was in ice, I hit the roundabout a little too nippy and just misjudged it. It doesn't make me one of the worst drivers on the road. It means that in six years of driving, I've miscalculated one roundabout, in bad conditions when my ABS was non-functional. On another day, the ABS would have kicked in and the car would have stopped. Stop getting on your high horse and start thinking in the real world please.
Another example, my girlfriends father was shunted a few months ago. Turns out the car behind cut out about 15 seconds before the crash and the driver lost access to the powered braking which is standard on ALL cars. Without it, most cars are pretty much useless.
Stop being a sanctimonious so and so please. No doubt when you make a mistake you'll be expecting the same sympathy as you're trying to suggest others don't deserve.
As for Lum's comment above, yes they have. It's called a dash camera. If we all had one, our premiums would be greatly reduced.
Your ABS wouldn't cut in on ice, as there wouldn't be enough resistance, and the ABS system would assume that you are stationary.
From what you have told us, the police would be unlikely to take any action against you. However, in the eyes of the insurance company, they would say that you should have allowed for the cold conditions, and increased your stopping distance.0 -

Like I said in my original post, I admitted liability from the off. I accepted it was my mistake, that was never in doubt. My issue is with the two individuals trying to claim large amounts of money and blag time off work when there was nothing wrong with them.

Firstly, you have absolutely no idea what car I drive or how old it is. It could be 5 years, 10 years, 15 years, I've not actually disclosed the age of my vehicle. ABS sensors are quite frail, despite being enclosed in the hub and can go on even brand new cars. After all, the sensors are located on a wheel itself. It only a small crack in the seal to allow grime, filth and other metallic compounds into the hub itself and ultimately destroy the sensor. I know plenty of people who have had that on cars less than five years old.
Secondly, how the hell do you know how I maintain my car? I'm a lot stricter than the majority of people regarding maintenance mainly due to the fact I do 25k miles a year. I probably check my tyres a lot more often than you do, and I because my car is absolutely vital for my job, I keep to my service schedule. Since when was it your job to judge? That's for an MOT inspector.
Thirdly, you have no idea how fast I was going so again, you are in no place to judge. In normal conditions, I would have stopped. Unfortunately, I made a mistake and misjudged the conditions. Something I've done once in six years of clean driving with no points, penalties or fault claims previous to that event. We all make mistakes and you're right, I've learnt a lesson regarding the road conditions and perhaps it was better I learnt it now than at high speed. However, to suggest I've learnt a lesson about my 'poorly maintained old banger' which I reiterate, could be a brand new car for all you know is a bit wide of the mark my friend. You sound a bit of a smug toff. What do you drive, a Merc? Wouldn't surprise me.
While we're on the subject of poorly maintained old bangers, seeing as you're such a smug sanctimonious !!!!!!, I reckon you should be the one to pay for those who do drive old bangers to get a new car eh? It's not easy for people less fortunate to buy a new car.

I'll try and address all the points in that multi paragraph, less than secure with yourself rant:
1) Your vehicle - I believe you have told people on here before you drive a Lupo? In which case your car is at least 9 years old, and due to the fact its braking systems are failing (or you're not maintaining it as well as you are making out) it would suggest its not in the best years of its life.
If I have got your vehicle wrong, I apologise, but take that factor out and it would be further proof that your accident was down to your poor driving or shoddily maintained car.
2) Your speed - you admitted yourself you entered a roundabout too fast for the conditions and rear ended someone. It doesnt matter if this was 10mph or 40mph, if it was too fast for the conditions then its too fast full stop. Your recklessness caused a shunt.
3) Your maintenance regime -If you're driving an old banger (be it a decade old lupo or whatever you have) the miles you do, you obviously need to be checking it a bit more frequently, with a bit more competence or have professionals look at it on a more regular basis. Perhaps then you wouldnt find yourself driving around in a faulty and potentially unsafe vehicle? I dread to think what else is wrong with it.
4) Actually you didn't make any more points, the rest of your essay was made up of petulant ranting and class snobbery. Like i said, seems like I struck a but close to home. My apologies.
Here's a tip for the future - perhaps don't tell a story where you readily admit to driving too fast in inclement weather with a faulty car, and perhaps don't follow that story up with a dissertation on how you're actually a very safe driver and how your car is actually in top condition?!

The only thing i'd point out Sinbad is before a fault occurs on a car, it usually is working fine.
I.e if the ABS is working there is nothing in a service plan or visual inspection that's likely to determine if the sensor is going to fail the next time you take it out a driver, or in the next 10 years.All your base are belong to us.0 -
Id hazard Stoke's car is older than 9 years old.
And yes, a 9 year old Lupo that does 25k a year and has faulty brake systems is a banger.

Great idealistic view there. Lets not forget ultimately were all human and can make mistakes, can misjudge a situation or could just have lost a split second doing routine mirror checks whilst something untoward is happening ahead.
Bet you've never bumped in to anybody in the street either, or accidentally grabbed a bag by just one handle or dropped your phone or anything else0 -

Ok, I'll address your parts as you have addressed mine.
1. You're right, I do drive a Lupo. The ABS sensor is a sealed module. No amount of maintenance can spot that. The only thing you can do is renew when it's time. I've already accepted that it was my fault. You're not taking the point of my post.
2. Yep. I've accepted that. Doesn't condone their borderline criminal injury claim.
3. Thanks for calling me incompetent. Short of changing the sensor every few years, there was no way to foresee my ABS failing. The MOT test is there to determine whether my car is safe. It's never failed.
4. Not really. I drive my car because it suits me. I use my car for work and it's never let me down.
I can only assume your sanctimonious ramblings extend to all parts of your life. Oh dear...0
