Personally I would replace whiplash with :
Any driver who runs in to the rear of a vehicle through not paying attention.
    3 points plus penalty .
Eventually the worst drivers will be off the roads.

If you are paying so little attention you hit the car in front you deserve to be marked given 3 points.
    Be happy...;)

if you report the incident to the police, that is what is likely to happen. Seen it a few times.
At fault with an accident = undue care & attention so 3 points and a fine normally.

I think this is complete !!!!!!!!. I've already said that in my case, I was in ice, I hit the roundabout a little too nippy and just misjudged it. It doesn't make me one of the worst drivers on the road. It means that in six years of driving, I've miscalculated one roundabout, in bad conditions when my ABS was non-functional. On another day, the ABS would have kicked in and the car would have stopped. Stop getting on your high horse and start thinking in the real world please.

Another example, my girlfriends father was shunted a few months ago. Turns out the car behind cut out about 15 seconds before the crash and the driver lost access to the powered braking which is standard on ALL cars. Without it, most cars are pretty much useless.

Stop being a sanctimonious so and so please. No doubt when you make a mistake you'll be expecting the same sympathy as you're trying to suggest others don't deserve.

As for Lum's comment above, yes they have. It's called a dash camera. If we all had one, our premiums would be greatly reduced.

That was intended as a dig at modern policing, not at you.

I didn't know modern policing existed. I thought they were too busy nicking people for doing 36 in a 30?

They were all far too busy when I witnessed an actual crime...
  • ABS is no use on snow & ice and can often increase stopping distances

A quick story. Last January (as in 13 months ago), I set off for work on a very cold frosty morning. Just a day or two before, my ABS warning light had come on to tell me that one of the sensors had failed, which meant my entire ABS system was disabled (might have made a difference, who knows?).

I hit a roundabout just a little bit too nippy and skidded at roughly 5mph in the back of a Renault Scenic. Two fairly big guys got out and we exchanged details, no big issue. I phoned the fella up later and asked if he would consider going private. He refused, which I was fine with. It's not for everyone. I admitted fault and his vehicle was repaired within the week, all seemed fine.

Two weeks later, I got a phone call from a lawyer (by definition) I'd been 'allocated' by my insurance. They were making an injury claim. I told the lawyer I thought it was a bit bizarre considering how slow the accident was and how little damage occurred. The lawyer explained it was just a formality, so I asked for more details. Both men had put a claim in. One had put a claim for whiplash, the other had put a claim for serious/severe (i forget which word he used) whiplash and a damaged knee. Anyone know the difference between the two forms of whiplash?

Anyway, I pressed the lawyer for further details. The man with the damaged knee had been off work for over a week due the accident at which point I flipped. Both men went to work that day and were in work all week as I failed to make contact with either of them later that week because they were in work. I pressed the lawyer more and he slipped that the driver was the one claiming for the knee injury.
I told my friend who works just minutes away from the drivers house to come home from work via that road. For weeks (while being signed off work), he was routinely outside painting the front of his house, doing the gardening, spannering his car, playing with his kids, yet was unable to work due to a badly damaged knee.

What brassed me off more was the incompetence of my own lawyer, who was so used to it, he didn't even ask for the details. I said "neither of them went to hospital, they both went to work". The lawyer said "oh I didn't ask that". I said "they were both in work all week". I got "oh, I know one of is off work now, but the other isn't". I told the lawyer that these were details he should have asked and said the reason compensation culture is what it is, is because guys like these two jockeys get a £2000 payout for an accident that barely happened and are simply not questioned about it.

Anyway, 13 months on, the claim is still going on as they refused the £2000 they were both offered. Unbelievable.

Its clowns like you, driving too fast in your poorly maintained old bangers that cause serious injury and damage to people.

You may be getting taken for a ride on this occasion, but if it teaches you to slow down and keep your car in good nick in future perhaps its for the best.

Huh? Where the hell did that come from? You mad bro?

Firstly, you have absolutely no idea what car I drive or how old it is. It could be 5 years, 10 years, 15 years, I've not actually disclosed the age of my vehicle. ABS sensors are quite frail, despite being enclosed in the hub and can go on even brand new cars. After all, the sensors are located on a wheel itself. It only a small crack in the seal to allow grime, filth and other metallic compounds into the hub itself and ultimately destroy the sensor. I know plenty of people who have had that on cars less than five years old.

Secondly, how the hell do you know how I maintain my car? I'm a lot stricter than the majority of people regarding maintenance mainly due to the fact I do 25k miles a year. I probably check my tyres a lot more often than you do, and I because my car is absolutely vital for my job, I keep to my service schedule. Since when was it your job to judge? That's for an MOT inspector.

Thirdly, you have no idea how fast I was going so again, you are in no place to judge. In normal conditions, I would have stopped. Unfortunately, I made a mistake and misjudged the conditions. Something I've done once in six years of clean driving with no points, penalties or fault claims previous to that event. We all make mistakes and you're right, I've learnt a lesson regarding the road conditions and perhaps it was better I learnt it now than at high speed. However, to suggest I've learnt a lesson about my 'poorly maintained old banger' which I reiterate, could be a brand new car for all you know is a bit wide of the mark my friend. You sound a bit of a smug toff. What do you drive, a Merc? Wouldn't surprise me.

While we're on the subject of poorly maintained old bangers, seeing as you're such a smug sanctimonious !!!!!!, I reckon you should be the one to pay for those who do drive old bangers to get a new car eh? It's not easy for people less fortunate to buy a new car.

Now jog on my friend, I think the Daily Mail has a new story for you to read.
  • If you are involved in an accident, then there's no blame - the clue's in the word "accident". It's tough, accidents happen. It's not nice, but life's not always fair. Let's say I trip over a tree root whilst walking through a wood, and break my arm. Not nice, but why should I expect to make some money out of the incident ? I wouldn't.

The word accident implies that nobody is to blame. This is why 'Road Traffic Accidents' are now called 'Road Traffic Collisions'.

It is very rare that there is nobody to blame in an RTC.
