    They've charged me a £20 early cancellation charge, even though it would have been loads more than that in reality. I've cancelled my direct debit though as I've already received my refund and used my PAC.

    I started a long thread about cancelling Orange contracts on the basis of their 2012 Ts&Cs over a year ago. I only came back to the forums today to add a post saying that they'd paid my claim in full once I'd finally taken them to the SCC.

    I had no idea they'd been at it again, but not surprised at all with their behaviour. Best of luck to all of you who are taking them on, but don't rule out taking them to the SCC if you fail with CISAS (who proved themselves to be pretty incompetent in my case) - it's easier than you might think.

    Used my PAC on Friday to port over to Three - £18 / month for unlimited texts and data and 200 minutes. The bonus is free 4G... (wow its fast, twice as fast as my home broadband in fact) and can use my free minutes, data and texts from certain countries on holiday woop!!!

    That's a bad deal if you didn't get a free phone. I too switched to Three for their £ 9.90 a month deal for 600 min and 1GB data (not to mention the £60 automatic cashback as well that I got within 1 week of joining). The trick here is once you pick up any plan you can put an Add-on of unlimited data for £3 a month which would mean you get 600 min and unlimited data for £12.90 a month (Not to mention free 4G)!

    Yes, mine is a 12 month contract, already 3 months into it so doesn't seem long enough to worry about considering the 24 month ones I used to be in the past!

    The bolt on you only get when you sign up to a contract and then add the bolt on by logging into your My Three account. This is something that Three don't want new customers to see.

    For example at present on their website the all you can eat data 12 month sim only plan for 600 minutes is £18 a month (http://www.three.co.uk/Store/SIM?site=d). However the 1GB plan for 600 minutes @ 12 months is £10 a month. If you go for the £10 plan and then once you register your account at Three.co.uk you will be eligible to add a £3 bolt on for all you can eat data at a cost of £3 a month. Top tip for any potential new three customers (saving of £5 a month compared to directly going for this deal from the start).

    P.S. I hope that three customer services are not reading this :)

    They have no right to charge the £20 - email and tell them the adjudicator decisions was cancellation WITHOUT PENALTY!
    You might want to copy in Ofcom (not they will do anything to their beloved EE), but I am sure the ONLY charge a mobile phone company can charge for cancellation is the remainder of the contract price.

    Great to find out the final conclusion of that battle - and better still to know you won.


    I honestly belief that all this activity shows that in the fixed term of the contract - no matter how the mobile phone companies try to dress it up - you can't legally have a price variation clause unless it is for legislative changes such as VAT.

    I've just received a letter from the money claims centre stating that my case has been referred to the small claims mediation service and I need to contact them ASAP to book a mediation appointment for the following dates: xx Aug-xx Aug.

    I need to go somewhere for 2 weeks this month (don't know the exact dates yet). What will happen if I cannot arrange an appointment within the dates stated above?

    And I wonder if anyone has any ideas of what will happen in mediation? In the letter it says that the appointment can take up to an hour (telephone based). How should I prepare for it? What should I do if the defendant agrees to terminate my contract back dated to Feb this year but does not want to pay any compensation. Should I accept it? Would the court think that I have not made every effort to settle the case If I insist on compensation, and then no agreement can be reached in mediation?

    Never been this far as EE have given in before this stage (they still may give in before the hearing).


    As for dates I'm sure if you contact he court and explain your holiday arrangements they won't hold that against you.


    In terms of prep make sure you have the CISAS case, EEs Defence, The response to the defence, and the adjudicators decision in front of you (and that you have read them over a couple of times).


    Remember the real nub of this is:
    That before EE could only use the lower of RPI or ANY OTHER inflation rate (e.g.CPI), but the new contract is RPI only , and the evidence is that the Feb RPI/CPI was 2.7% v 1.7% (58.8% diff).
    All the garbage EE have said about making the clause clearer is irrelevant as it makes it clearer they can apply a HIGHER price rise than they could before.
    The Ofcom guidance to update T&Cs was not compulsory to apply to existing contracts (no other operator has changed existing T&Cs because of it)
    Material Detriment means - changes that are not to your benefit or neutral in their impact on you.


    As for compensation - the SCC won't award any so by all means ask for it, but don't walk away from a decision that goes in your favour apart from the award for compensation.
