    Finally EE have sent me a cheque.
    The cheque actually has Tmobile written on it for some reason, even though I was on an Orange contract.

    The amount however, is different to the amount I was expecting.

    They (obviously) have not paid me as much as I calculated.

    I have rung them twice to enquire how they have calculated the amount they have sent me, but both times they have put me on hold for over 30 minutes and then the line has gone dead.

    Does anyone have any ideas on what to do next?
    Has anyone else had a case with Orange where they have been sent a cheque from T-Mobile?

    I could do with your help. I have had no luck in cancelling my contract early due to these changes.

    I now have a country court claim open with them with a date in September.

    Can you advise what I need to say in my defence to the changes that EE have made to my contract. (my contract is EE4G)

    I have read through all the information on this thread but I don't really understand it.

    Well thanks to all on here I finally got the better of EE and through CISAS won against them. Got my PAC code and unlock. However, before I could action them and get on to a pay as you go sim deal a lady from EE called.
    Told me how much she wanted me to stay with EE and asked what I intended to do next about the phone. Told her about wanting a sim only deal and she came up with one that suited me and then knocked the price down. Of course on principal I at first said no but getting cost down from original contract of £39 to £7.99 a month was too good a deal. Also it seems I can get out of the contract at any time with a months notice. So far it seems to be working well.
    I know it sounds like a sell out but if EE get it wrong at any time I'm out of there. At least there having to work for my business now.
    Anyone else had them call.

    As my conversation with OFCOM/CISAS went

    CISAS make a decison

    X fails to action

    CISAS says its has no enforcement power and refererences OFCOM

    OFCOM says it will take it on board but it is for CISAS to resolve and the sancton is for CISAS to remove X from its scheme therefore making the X unable to operate in the UK

    CISAS wont do that for reasons

    a) Money
    b) Legal Threat

    End result a system where there is no final recourse other than going to the courts to get it actioned which defeats the whole purpose of ADR

    I know exactly what you mean, in my case T-Mobile failed to comply with a rather bad CISAS adjudication. They did not back date my claim as they said 'i would need to have a contract anyway' so i might s well pay T-mobile. Only allowed me to cancel with £50 compensation.

    To Quote Taylor decision:
    "The customer seeks a refund of monies paid since his cancellation request. I do not see that the company should refund all charges since the request for termination. The customer has had the services available to him during this period and appears to accept that he has made use of those services during the relevant period. He would have had to pay something, even if he had been released from his contract and transferred his mobile number to an alternative supplier. I have not been provided with any information regarding any other deals he might have done had his termination request been accepted, or savings that he may have been able to achieve from this. I therefore find
    that the customer's claim for a refund of monies paid since his cancellation request does not succeed."
    As can be seen, he completely missed the fact that by not allowing me to leave, T-Mobile did not give me the choice of paying another provider, the whole crux of the argument. The fact that he says i did not provide enough information about other deals i may have had is ridiculous, the fact that i entered a CISAS claim surely shows i did not 'accept' my situation, absolute joke of a decision...
    To quote my defence, which he clearly ignored:
    'I have used the service because I have been forced to continue with T-Mobile,

    I have no choice. I have asked to cancel and they refused, so any charges I have

    incurred have been of their own making.'

    I've got my PAC code but they STILL haven't paid me my refund, despite agreeing on an amount.

    Still haven't decided on what I'm going to do in accepting or rejecting the CISAS decision to side with them. I'm not convinced I'll win in SCC with being out of time. :(

    Reject the decision (as they sided with EE anyway) that way you can decide later whether or not to take it to SCC -if you accept the decision you will not have an option to go to SCC.

    Just signed up to say thanks to RC and others for their input on this thread, I've just won my case with CISAS using your templates :D

    Just waiting of my PAC / refund, so not completely sorted yet but well on the way!
  • Used my PAC on Friday to port over to Three - £18 / month for unlimited texts and data and 200 minutes. The bonus is free 4G... (wow its fast, twice as fast as my home broadband in fact) and can use my free minutes, data and texts from certain countries on holiday woop!!!
