    I agree Ofcom are so useless they are unlikely to do anything, but just from their obvious mis reading of the impact of the change in T&Cs "does not purport to give EE the right to impose a higher price rise" and then so obviously ducking the follow-up gives me more ammunition! And the more engage the stronger the case they build for us :)

    Good to see results still coming in. To be honest I wondered if I was too late as I didn't challenge the T&C's until well after a month: the phone is actually used by my son so I never got the texts.

    But a few minutes ago the email arrived:

    Decision

    1. The claim succeeds.

    2. The company shall terminate the customer’s contract immediately, refunding all charges

    imposed since 14th April 2014.

    3. The customer is awarded compensation in the amount of £100.00

    Adjudicator: Stacey Edgar. Contract: T-Mobile.

    I used the templates with a few minor amendments to tailor the complaint to my circumstances.

    Thanks once again to RC. It's shocking that some people have missed out with exactly the same details just because of having a different adjudicator; it's shocking that the only people able to benefit (it seems) are those who happen to have come across RC's sterling work and have the tenacity and time to read the information and act on it; it's shocking that Ofcom are equivocating about what is now to any reasonable person a clear breach of their own code; and finally, it's shocking that there hasn't been more on this from the mainstream press, or even from this very site apart from in the forum.

    Just received this:
    I direct that the company pay the customer compensation in the sum of £75, cancel his contract

    without penalty effective from 15 April 2014 (subject only to any appropriate charge for actual

    use by the customer since that date) and provide him with a PAC.

    How long are people waiting for their PAC codes?

    I got a mail saying they'd follow, but still haven't heard anything. I accepted the CISAS decision on the 9th June, they acknowledged it on the 13th June and T Mobile sent me the following on the 19th June:

    We write further to receipt of confirmation from CISAS that you have accepted the Adjudicator’s Decision in relation to the above matter.

    We confirm therefore that the following actions have been arranged in respect of your account:

    • We have arranged for a PAC code to be provided to you in respect of both active lines on your account so that you can retain your two active mobile telephone numbers.
    • We have arranged for both lines to be taken out of commitment so that no early termination fees are charged when your numbers have ported out and your account has been cancelled. We will arrange for any remaining unpaid charges on your account after your numbers have ported to be waived.
    • Once you have used the PAC to cancel both lines, and the account has been closed, we will then recalculate your bills and provide you with a refund of the relevant backdated charges, backdated to 11 February 2014. If you could indicate whether you require a refund by way of BACS payment to your bank account or by way of cheque payment we would be grateful. If you require a BACS payment we would be grateful if you could provide confirmation of the relevant bank account and sort code.

    We hope that the above clarifies the actions being taken in respect of the Decision and we confirm that the above will be actioned within the relevant timescales as set out under the CISAS Scheme Rules.

    I replied with my bank account details requested a BACS refund and said I await my PACS. Don't get me wrong, I'm in no hurry at all, I'm just wondering how long they're allowed to take?

    I lost my claim with the CISAS.

    I submitted a money claim to the county court money claims centre few weeks ago. I've just received the company's defence (70 pages... )and I am just wondering whether you mind helping me to prepare my defence in this thread?

    Wow, so they're defending it in court? I'd have thought they wouldn't bother, or do they always do this and then drop out on the day?

    Yes they are. I've just received their defence and the document has 70 pages in total :eek:
    I am working at the moment. I did not really have time to read the defence properly. I will read it again tonight when I got home.
    But I think I might need some advice to prepare my defence and I would like know if this thread is CISAS related mainly? Can I post information relating to Small money claim here?
