Hi RC,
First time poster here - signed on because I wanted to say thanks for all your work/guidance. Got my decision back from CISAS today.
I had partial success:
I direct that the company terminate the customer’s contract without charge, on a backdated basis, with only monthly plan payments refunded as if the notice were given on 3 March 2014.
Should I take this to mean all my charges with Orange - I'm nervous about the bit underlined could this mean my set contract fees and not anything above that amount - for example £31 a month contract?
Thanks,
MBM
I would read that as your normal monthly line rental but does not include any additional charges you may have incurred outside your contracted allowance, e.g. calls abroad, roaming, maybe 0800 numbers if they are not included etc.0 -

This is a little bit naughty, as EE are making money rom you when you should never have had a contact with them as it should have been cancelled.
If the sum is of any significance to you then accept the decision but add:
"Under GC 11.1 EE are obliged to provide correct bills, As my contract should have been cancelled from DATE, any bill (regardless of if it is the core subscription, or "out of bundle" charges) is incorrect as there should have been no contract for EE to bill against. In accepting the decision I reserve the right to bring a fresh case against EE should EE decide not to refund "out of bundle" charges".0 -

Just received a responce from ofcom, have you received one as well? If not I can share it here0 -
Monday is deadline day for me accepting CISAS's decision so I will be accepting it late tomorrow afternoon just to be on the safe side, should then get another free month maybe before I get the PAC and then will use 28 of the 30 allowed days before I use the PAC. I love free mobile use at EE's expenseA big believer in karma, you get what you give :A
If you find my posts useful, "pay it forward" and help someone else out, that's how places like MSE can be so successful.0 -
I got the dud adjudicator and as I expected, he has decided against me despite using the templates etc. What is my next step? Small claims court?0
-
My claim against EE was successful and I have successfully ported out to another network.
However, the Adjudicator has not ordered them to refund my line rental for the time spent waiting. I have told CISAS and I am waiting on an email from the Adjudicator. I have also contacted EE twice about this and have threatened court action if they refuse to refund me. I have been told that my request has been transferred to the relevant dept by the person in retentions who initially cancelled my contract.
Any advice on how long I should give them to reply?
I have had enough of this company messing me around. NEVER again shall I sign a 24 month contract. My advice to get around signing up for a contract this long yet to get all the benefits of one is to purchase an unlocked phone through giffgaff.co.uk on a credit agreement 6, 12, 18 or 24 months) and either use giffgaff or find a 30 day SIM only deal which can be cancelled at any time!0 -

That's exactly what I did/am doing. I'm just waiting for the PAC now, they're taking their time but that's fine by me!0 -
Score 63-5 (Excluding T-Mobile pre Oct 2012)0

Yes it will be - was her reasoning the:- Questioned your motive for entering the contract and:
- Questioned why you did not seek to have the T&Cs left unchanged?
