    You are correct. You should also get a part refund of The payment made on 2nd Feb.

    My case was a EE contract taken out in October 2013 £47.99 per month contract. I used both your templates and won.

    The adjudicator found in my favour in full.

    All monies paid to be refunded to February
    £100 compensation
    To be released penalty free with PAC code
    For my phone to be unlocked

    I have accepted the adjudicators decision, can someone tell me what the time frames are now please, I am also need to know whether
    I have to ask for the phone to be unlocked from EE and pay the £20 which I am guessing will be refunded or whether this will be done automatically?

    I am hoping to go on a pay monthly sim plan with 3 mobile now with unlimited data for £12.90 per month. Hopefully I will get a better quality of customer service.

    Thanks RC, thought that was how it worked, well Ive sent them an email, wanting an explanation for the amount they have qouted, lets see what next week brings.

    After accepting the decision from CISAS EE took nearly the full month they had to comply to contact me with my PAC code, shortly after I received a cheque for the £100.00 compensation and Im now in a disagreement with Orange on the amount I am to be refunded. I think it should be approximately £170 as opposed to their £94.

    Did you mention the other number in your communication with EE before going to CISAS?


    If so then you can contact EE and tell them that you will put in another claim (including compensation) to CISAS - unless they want to honour the contract and GC 9.6 and give you a back dated penalty free cancellation. You won't be "time barred" from taking another case if you had already mentioned it in the earlier correspondence.

    I have emailled EE and they have stated that my contract stands. Can you please explain what I should put in my CISAS claim please. I was following the thread but there are so many responses I'm unsure on which one I should be using. Many thanks

    Finally left EE, the whole process has taken four months but it's been worth it. I moved over to Virgin Mobile (who use EE anyway) unlimited mins and texts & 2GB of data for £12.75 (nus discount) saving me a total of £645 over the remaining 19 months. Thanks again to everyone.

    Dear mr Swantee.

    Thank you for you email - can you confirm that dispite CISAS concluding that the change in T&Cs is to my Material Detriment under both the contract and GC 9.6, in exactly the same circumstances EE consider that no Material Detriment has occurred on my other contract? Whilst in the first instance it may have been an honest belief that no Material Detriment had occurred now that EE are aware that this is not the case can you please clearly articulate what is different in this case which leads EE to believe no Material Detriment had occurred as it appears to me that EE are not applying the required principles of Good Faith in dealing with me. I trust that on reflection EE will reconsider its position and process the back dated penalty free cancellation that I an entitled to under the contract and Ofcom regulation GC 9.6

    I have a missed call today which could be off EE.

    What if I keep missing their calls, will they email me a PAC?

    Once I have the PAC, how long will I have to use it? How long will the refund the line rental until?

    For example, if I get a PAC next week and wait 3 weeks to use it, will they refund me all my line rental from February until my account is finally terminated?

    Also, is it possible to not use the PAC and negotiate a retention deal with them, or will contract still apply if PAC isn't used?

    Why not just answer the phone?
    You will have a month to use your PAC and as stated in your CISAS decision they must refund all line rental and charges back to Feb, so yes you can wait 3 weeks to use your PAC and still get all monies refunded.

    I would be weary of negotiating a new deal with them you could be opening a can of worms, it maybe better to port out and then back again if you want to stay with EE.
    Finally yes, if you dont use your PAC within 30 days it will expire and your contract will just continue.
