    I'm wondering if I can still chase this route.

    I'm in the unfortunate position of having a claim against T-Mobile open dating back to the end of February, relating to two numbers on my account. CISAS upheld my claim (yesterday!) but says it only relates to one number. (This was an unrelated claim cause by T-Mobile blocking my handset and refusing to unblock it for 6 months).

    The other number is the one in question on this matter. It's an account from 2012 with T-Mobile. The contract expired in February, and due to the CISAS issues, has been accruing charges for the first few months of this period. Due to the way T-Mobile handles their billing, it was impossible for me to pay against just one number and not the other.

    As the account is currently in dispute (with 5 weeks, 5 days left) I don't know where this leaves me. Is there a way I can back-date this claim for breach of contract WRT price changes?

    Was that all you sent to CISAS, or did you send the Appendix 1 and correspondence?


    If you sent the template as well you need to see the standard response http:// fightmobileincreases .com/ fight-ee/fight-the-march-2014-price-rise. If you only sent the brief details then this I going to be difficult for you.


    You will need to address each point - with evidence (which should have been sent to CISAS already - so they may disallow anything you send now).


    For Instance charging £3.50 when contract says £3.00 you need to send a copy of the contract and a bill and point out that under GC 11.1 EE have an obligation to provided correct bills - failure to do so can result in a fine from Ofcom of up to 10% of turnover (like Ofcom would ever do that!!!), but it won't get you out of your contract.


    Regarding coverage - if you can prove (speed test results) that the service has deteriorated since EE started moving to 4G then you can argue that you are not getting the bargain you signed up to and therefore should get a penalty free cancellation. If coverage has always been bad the you will need t prove that EE mislead you.

    Yeah, I sent just that brief description along with photos of my bill & contract showing the over payment of the non direct debit and I also included 3 different speed tests that were from different days.

    Looks like you've got it covered then - just refer the Adjudicator back to your evidence.

    T-Mobile pre 30th October 2012 contracts are very difficult to win due to the change in T&Cs. In regards to the price rise it did not apply until late May - so after the contract has ended.

    Hi. I know this may have been asked this 1000 times, so apologies for this post.

    I have won an early termination case against Orange for terms and conditions changes thanks to this forum, however 4GEE won't release me from my contract as they have stated that I made no reference to my 4G account. What post should I copy and paste to them please?

    My 4G contract was taken out in September 2013. Many thanks in advance

    Did you request cancellation for the 4G EE account in your CISAS case? And did the adjudicator make a judgement on that contract?

    I thought I did but evidently not. The reply from CISAS
    stated that I only made reference to an orange account and not my 4G account.
