    Hi all,

    Received a letter from EE today regarding my business account - 51 handsets on a 3 year contract stating that as of 10th July I will be faced with a 2.5% increase to my monthly voice and text plan. It also states that my current T&C's remain unchanged.

    Am slowly wading through this huge thread but if anyone has any idea if I can challenge this as a business user I'd be grateful for any advice!

    Good work on the results that have been seen so far.

    I have received my PAC from EE and today received the £100 comp, along with a final bill asking me to pay £35 I am confused as CISAS asked that they refund any previous bills from 13th feb. Has anyone had a final bill? And what did you do thank you in advance

    Okay to update I emailed them and they said the bill was sent out in error and they apologise but they also said my balance is nil and no further action is needed? Will they be sending me my back dated payments I shall wait and see. How should I read that, no further action is needed?

    I think you may be stuck with the contract.
    On this forum (T&Cs) and the price rise forum ( https://forums.moneysavingexpert.com/discussion/4818999 )we have used the protection of G.C. 9.6 and the UTCCRs which only protects consumers and small businesses (up to 10 employees).
    Not sure how a Business to Business contract would work, other than if the contact mentions material detriment than perhaps you could (as a business) make the same arguments - that the change is of material detriment to you.

    Who can complain? You can use CISAS if you are a consumer or a small business with an unresolved complaint against a member of CISAS, but only if you are a customer of that member. A small business is defined by Ofcom, the telecoms regulator, as a business with 10 or fewer employees. If you are a business with more than ten employees, and you are claiming more than £10,000, please contact [EMAIL="info@cisas.org.uk"]CISAS[/EMAIL] for further information.

    Did you mention the other number in your communication with EE before going to CISAS?


    If so then you can contact EE and tell them that you will put in another claim (including compensation) to CISAS - unless they want to honour the contract and GC 9.6 and give you a back dated penalty free cancellation. You won't be "time barred" from taking another case if you had already mentioned it in the earlier correspondence.

    I had the same but I also got an email from the executive office stating that the refund had been calculated which I replied to asking for a breakdown.

    Yesterday was their deadline for complying with the decision and, like you, I've only had the compensation and a PAC so I have emailed CISAS copy to Lynn.Parker@Ofcom.org.uk detailing their failure to comply.

    According to the email from the Executive Office the compensation payment was processed on 27/05, it reached my bank on 9/6 so either they lied about the date it was processed or they use some third world bank that send stuff by surface mail.

  • Looks like after I have used the PAC codes from EE they have charged me £600 odd making me overdrawn. Does anybody have an email or number I can call to get this resolved?

    First - call your bank and tell them to bring the funds back to your account immediately as per the DD guarantee (tell them you won a legal case and can prove the charge is illegal)
    Second - Email EE (copy in Ofcom) and tell them they have:
    • Breached the CISAS ruling by charging you for the PAC
    • They have breached GC 11.1 - as they are duty bound to only issue correct bills (ask Ofcom to take enforcement action).
    • Inform them you have used the DD guarantee scheme
    • Inform them that when the impact of the bank charges is known you will bill EE for the cost PLUS a £30 administration fee for the time effort and inconvenience caused

    I finally escaped EE/Tmobile after 5 years - last month, taking out a pay monthly contract with THREE and I can tell you - it is like a breath of fresh air - the connection speed (3g) is much higher (up to 6Mbps - time dependant) compared to a miserable 1Mbps max - and no more breaks in service and I am paying less for unlimited internet than I was paying EE for 1Gb/ month
    So - please feel free to come and join me on THREE !!

    Can anyone confirm when we pay a bill that we pay for the line rental in advance?
    I have just received an email from EE confirming I will be repaid £94.87 however they have taken payments for the months of March £36.08 ,April £36.08, May £40.04 and June £37.34. I believe my billing date was the 15th of the month and payments were made on the 2nd of the month.
    They are due to repay all charges from 25th February. Can anyone shed any light on this? Thanks in advance.
