If you think that either CISAS or OFCOM have been swayed by EE - then perhaps it is time to start lobbying our MPs to ask questions in parliament about the whole setup of the REGULATORS/ DISPUTE SETTLERS - Because OFCOM (at least) is (partly) Publically funded and as such should be totally fair and independent ...
CISAS - it appears is wholey funded by the telecoms industry - which, to me - reeks of possible misdeeds !!
I will be interested to hear if and when EE pays the £100's that it has been asked to pay by CISAS - Because CISAS has no power to force a company to actually make payments - it merely advises. It is down to Ofcom to enforce the payments !0 -
Hi there
I'm new to this thread and the forums but I received a letter from EE this morning making me aware that prices will be rising from the end of May. I took out my contract at the beginning of April 2013. Are they breaking any clauses here? Sounds as if by this thread that a simple phone conversation won't suffice in getting a cancellation result? If anybody could provide me with some information on what to do regarding this I would appreciate it very much. As I'm a bit confused when scanning through the thread
Many thanks0 -
Maddy2k11, I would suggest a formal complaint to CISAS. Google "CISAS complaints procedure" for the form and details..
Amusingly the form says:
"We can, however, only deal with complaints that raise concerns about poor administration. We cannot investigate complaints about decisions made by our arbitrators or adjudicators, or the decision process they adopt, or any business decision of IDRS. Also, we cannot consider complaints about the content or validity of the procedures, rules or timescales of any of the services we provide, although we will consider suggestions for improvements as we consider appropriate."
It does say though:
"We will:
• treat all complaints seriously and deal with them properly;
• address complaints promptly; and
• learn from complaints and take action to improve our service."
Looking at the details of your case, I think you might have a claim on them the first two parts of the above. As for the third, the issues from your case have existed in various previous cases that Random Curve has helped people out on i.e. exact same cases but incompetent adjudicators or a failure to judge identical cases equally because of how they are presented.
If they try and reject your complaint on the basis of the first quote above, you can request it is escalated to a director within 4 weeks.... please do follow this through, only by getting it infront of the noses of the directors and disturbing their "working lunches" and "golf club meetings" will these errors be corrected.A big believer in karma, you get what you give :A

I opened my case with them on the 8th and had confirmation e-mail within minutes. Submitted my additional information by e-mail the same day and had automated confirmation..... had nothing since though.
I guess they might be a little busy at the moment with these claims.
They normally aim to reply within 5 working days to e-mails so if you don't hear anything after say, 4 working days, then I would ring them up.A big believer in karma, you get what you give :A

Generally you get communication from CISAS the day after a deadline has expired.0 -

Start on post #744 (rejecting t&c route). After you have sent the first email, visit post #800 (rejecting price rise route) and send an email described in it. Then concentrate on the t&c route, if you are unsuccessful you can pick up the price rise route again.0 -
Im in the same boat sent evidence to cisas on the 6th hopefully get a response on monday0

It should be really interesting where all this ends, my thoughts are starting to build a case against OFCOM and their refusal to get involved with all of this.
Pretty much using the same tactics, as with EE, sending emails with read receipts and building up a case of several emails, where OFCOM are ignoring direct questions put to them.
Then after building these up, sending them off to the relevant mps.
I dont agree with my taxes funding consumer protection that is more interested in their vintage wines and golf afternoons with Olaf than carrying out their role.
Some my disagree with me, but given on my own experience with OfCom, this is how I perceive them.
Lets show them, what the power of the internet can do.0 -
Thanks to everyone that has a look over the response I got. I think the next step for me will be pursuing the small claims court as quickly as possible. I do have a couple of questions if some people wouldn't mind answering them:
In regards to a letter of intent, should I simply inform the executive office via email of my decision to pursue the case at the small claims court, explaining my thoughts using the previous templates and arguments?
From this then, I should formalize my case with the SCC using any template RC had had made previously, or a new template? And do I mention the unsatisfactory result of the CISAS case?
I have looked at the complaints procedure, but I feel that they will simply hide behind the fact that they do not discuss complaints related to certain outcomes. I guess it wouldn't hurt though to see it through.Car Debt at 0% - 5304
