    Thats probably what is was weller :eek:

    They say that the male driver was *seen* - other than the fact that he doesnt smoke we rarely have the windows open in the car anyway - if its too warm we use the air-con coz its still a novelty to us :rotfl:

    Depending on how bolshie she wants to be, it might be an idea for tigtag to reply to the letter, but to omit the not-smoking part - and see how far they wish to push it.

    It reminds me a bit of Saffronflowers (IIRC) run-in with the bailiffs. At the end of day they'll turn around and say someone needs "further training", whereas the police should be turning around and saying "attempting to obtain money by deception"...

    Ok chaps - here is my letter - please feel free to pull it to pieces:

    I am writing with disgust and outrage at the fixed penalty notice I received in the post this morning issued by one **** *****.

    Whist I am in agreement with the zero tolerance policy applied by Leeds City Council with regards to littering your enforcement officer has made a very grave error of judgement.

    The offence that Mr ***** alleges is in relation to cigarette litter being discarded from my vehicle, an allegation that I 100% vehemently deny. Aside from the total and complete lack of evidence to support your allegation I am not even a smoker.

    I suggest that if you do not take the sensible route of overturning this notice you apply one or all of the following to substantiate your allegations:
    • Photographic or video evidence of the alleged offence.
    • The actual cigarette litter which is in question in order for DNA evidence to be extracted.
    • An invitation to meet with medical personnel of your choosing and at your cost in order for testing to prove I am not a smoker.
    I will not be made a scapegoat for your department to provide revenue to justify its existence. This allegation and fixed penalty notice teeters very finely on the edge of obtaining monies by the way of deception.

    I suggest that you arrange for Mr ***** to attend further training courses or sessions on what to actually look for and what evidence to gather before he sees fit to issue the aforementioned notices to innocent members of the public.

    I expect to hear from you will a full written apology within 5 working days of the date on this letter. This letter has been sent recorded delivery.
