    This is the route we are going to go down to be honest. At the end of the day they wont have their proof - being that he didnt do it!!

    I am sure that they are just trying their luck in the hope that some poor suckers pay up - to be honest I cannot see how it would stand up in court (which OH is prepared to go as far as)!!

    I wrote a letter for my friend re something similar, she contested it as she didn't smoke. We asked them to exhibit the cigarette so that we could perform DNA on it - soon shut them up :D

    I wouldn't have believed this had I not seen your post, how can you fine some one for litter if its not on the spot. How on earth did they decide it was your husband? I would fight it all the way as it wasn't him what a flippin cheeck. I'm all for fining people but only if you catch them on the spot.

    This is exactly what my dad said, thanks for that tip - I think I will put that in the letter.

    This is just how he feels misspoppy - he said its like the police coming along and locking him up for a robbery that was commited near where our car was seen - NO EVIDENCE - as mad as I am about the whole thing I am pretty confident that we will *win* our case :)

    I agree with misspoppy on the fine thing I must admit.

    If you catch someone on the spot dropping litter then fine them and quite rightly so if they can't be bothere to find a bin.

    But to fine people days after the event is just a joke and a bit extreme to be honest. Pay the wages for extra community officers to walk and drive around and give people on the spot fines instead of plucking a car registration out of the DVLA records like a bingo game and see if you can get the money out of them.

    Or terrible that people are receiving fines for things they didn't do?

    When he first read the letter he was gobsmacked as it was as we are VERY anti-littering but then to continue to it being a ciggy........
