    I doubt we'll see him any time soon.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Sadly Bams has failed to reappear after needing help with his CCJ over a PE case. Shame he/she couldn't find the help needed. You are a cynical lot. It's almost as if you believe that parking companies stoop to underhand methods to trick people into thinking these companies run a fair and ethical business.

    Speaking of which. Where's Perky these days? I miss him. He was funny, he was!!
    He is proberbly with his new internet russian wife called olga?
    PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:

    Case #1

    Barrow-in-Furness County Court
    19th December 2013
    Deputy District Judge Buckley
    Case no. 3JD00517
    Parking Eye v Clarke

    This was an overstay case at The Range, Barrow, and I provided the defendant with his defence, plus some pointers on how to conduct the case in court.

    This was his report in his own words:

    Hi David, as you know I appeared in court this morning and the case was dismissed and leave to appeal was refused, the judge (nice man) decided that PE’s GPEOL didn’t hold water as they were not the landowners therefore no loss had been established, the Judge seemed to focus on PE v Sharma. PE’s solicitor argued at some length that PE’s normal everyday running costs/expenses to be legitimate and therefore defendants were liable for these costs and cited several cases where this had been tested, I had earlier argued that normal running costs/everyday expenses were tax deductable in their year end profit / loss accounts and defendants were been unduly penalised. ... Where does this ruling leave PPC’s and their unfair business models surely this has shot massive holes into their broadside together with POPLA refusing to endorse their GPEOL’s, how will Capita view their recent purchase hopefully they will be asking for their money back.

    He has applied for the Approved Judgment, which will be available shortly on the Parking Prankster's site.

    Parking Eye v Pearce

    This chap had never been on the forums, but the facts of his case were identical to the one above and followed on straight afterwards, so it was easy for the Judge to reach the same decision.

    He posted about it on Facebook: Mark Pearce The judge ruled against PE in the case before ours and I think had already decided to rule the same for us before we went in. He ran my defence for me, interrupting if he felt I was going wrong. The verdict was that as PE were not the land holder they could not quantify losses therefore any charges were punitive. I also had not entered a contract as the signage was unlit and could not be seen when entering from Duke St. so therefore could not be held in breach.

    Another bad day at the office for the Wicked Witch of the North West.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
