i'm guessing this is the listing
http://www.ebay.co.uk/itm/playstation-3-games-bundle-8-games-/171192852198?pt=UK_PC_Video_Games_Video_Games_JS&hash=item27dbe39ee6
not a lot written really, whether a buyer should have to assume anything is debatable, however the seller has not done a good job of listing and should have just accepted the cancellation to my mind.
I buy and sell in this category a lot and have learned to pretty much ignore the "condition" as it does not really work, "acceptable" only for just missing a manual is nonsense.
reading this listing i'd have assumed that the first 6 came in proper cases with inlays and the last 2 where disc only.
Manuals for all would have been questionable, not everyone thinks about them.
Overall think the buyer has assumed too much and all this talk about SOGA is a bit far fetched really, however the seller has not listed well and should have cut their losses, accepted the cancellation and everyone could have moved on!
If that is the listing then I would have assumed they were disk only. Also, I'd say you won the listing for a decent price even if them two were disk only. I don't understand why you were so bothered about the inlays, you could have easily sold them for a decent price as is if you didn't want to print the inlay. If those were two you really wanted then you can get them cheap enough complete.Intention is to buy all of the games and use all of the games. I would then take an informed retrospective view to then choose to play some or all of the games and move the rest on, if applicable. As they are my personal belongings and intended for personal use, it isn’t under business selling.
If you buy to resell that is a business. It's not your intention to buy and use them all if you know you'll decide later on whether to actually play them or resell them. We're not talking about manuals though are we? Inlays; the bit between case and plastic sheathing. Manuals I can give or take personally (unless it’s something special like in GTA) as quite a few are on disc. But as with the wheels and pedal, you only know what’s not there if you know it isn’t.
It didn't say the inlay was included therefore it's not mis-described.
That last line is confusing me. Maybe I'm just tired or something, but it's not making sense to me.0 -
Thank you Paul. That’s what I wanted. Simple response, to the point, and the correct listing to boot!
Whether my posts in this thread can be seen as trolling or not and whether what I was posting is intentional, it is interesting to see people’s perceptions and interpretations of the rules. I do a bit of buying and selling on eBay, some on classifieds, mainly though low level SE business. This one I knew would get some high horses being mounted. Why? Because it is so petty an issue.
(Just note, I’m not doing this to wind people up, but threads like this are good for people to read to know what people can expect on eBay. Experienced or not, the buyer is being picky (maybe too picky) and has a nauseating right to be because eBay allows them too. However, the seller should have not have given them a chance to be)
Regardless, still shouldn’t have relisted them until closed and cancelled!
We all gave simple, to the point answers. In fact, I'm sure my first answer was much shorter and to the point, you just didn't seem to like the answers you were getting.
If you wanted the listing you could have posted it yourself.
I think it's interesting to see everyone thought the same and assumed disk only except you. Nothing to do with rules, it just seemed the obvious answer to us.
I agree with the relisting though.0 -
LOL! Pot.... kettle !!!
I still feel sorry for the seller
I throw the bait. Up to you to biteAs said above, I’m posting with a whirlwind of propositions and probabilities (along with a tirade of carp too)…all of which are extremes but possibilities. It’s a Friday afternoon…nothing like a whirlwind in a teacup for a bit of comical effect at the end of the week

eBay said not to due to description not being accurate and non-payer would be removed if applied.0 -
I will admit I do not know a lot about ps3 games but you got 8 games for under 2.50 ea I would call that a bargain cases or no cases yet you are complaining.
If you planning on re selling then perhaps it is not so much of a bargin as you are looking to make on that, as a personal seller I have come across re-sellers buying my stuff before and they are a nightmare to deal with!
You are correct in what you say they certainly should not have re-listed before you cancelled, have they sent you the cancellation request? What if they sell then you pay  then they would be stuck!0 -

I know, I know. I was stringing it out for as long as possible.
At the end of it all, it is annoying that the two which are missing inlays are two of the most valuable ones.
The seller basically didn’t give two hoots when I messaged them (short shrift couldn’t give a monkies response) which is when I asked for the bid to be cancelled as I couldn’t rely on their description and it would save us both trouble if there was any more problems0 -

Unless I miss read it, the listing did say which two were missing the cases.
They should have just cancelled the listing for you though.0 -

In all fairness if the seller had come on here with this scenario my advice would be NPB and BBL. Never would I cancel with someone sending two patronising messages. With a NPB the buyer cannot leave feedback or if he does it will be removed when the case closes.0
