newlyn debt collectors, parking fine.

hi all,

i have posted here previously, and scoured the forum for advice and info. and kept ignoring the letters from excel, roxbrugh and now i have
had a few letters from newlyn. all have been ignored up till now.

this morning i had a letter from newly again but with "DO NOT IGNORE THIS LETTER - COURT ACTION PENDING''
this was the header of the letter. exact letter was.


PARKING CHARGE DETAILS :- Peel Center - Stockport
TOTAL OUTSTANDING: £166.00
dear sir/madam

we are instructed to recover the above sum, arising from a Parking Charge Notice issued by our clients Excel Parking Services LTD.

You are formally advised that unless the payment is received in 14 days, proceedings will be initiated in the County Court where a Judgment may be obtained. The County Court Judgement (CCJ) may then be enforced by a court appointed bailiff which will incur substantial costs, It is therefore in your interest to pay immediately.

If you are unable to to meet the above request or should you wish to make a short term arrangement to clear the account, please contact our office on 01604 625130 immediately.

and yes that ''to to meet the above'' is how they put it. minor mistake but not one i'd expect from such a company.

anyhow how is this just another idle threat to scare people. or are they dead set on taking this to court.

anybody else dealt with these, or had anything similar.

any info and insight is greatly appreciated. thanks in advance.

  • Sounds like exactly the same letter as I posted about today. (See a bit further down the forum). I would think the advice given there applies.

    plenty of info already on here as the forum is awash with similar threads and posts

    there are at least 2 sticky threads at the top of this forum with specific advice about this, including the newbies thread , so what you should be doing is reading those sticky threads, also use the search forum tool for similar threads too

    as for this problem, you would have appealed it at the time and if necessary gone to POPLA and won (as can be seen in the POPLA sticky thread , also at the top of this forum)

    to be blunt - by ignoring the initial PCN or NTK you effectively agreed by default to be hassled by debt collectors, and possible court action, so it should have come as no surprise to you that you are receiving DR letters

    yes your right, i should have appealed, but like many say. just ignore them and they should get bored and go away. im just wondering if they are intent on court action or just being scare mongers?

    no, they are debt collectors so will not take you to court

    they would refer it back to the creditor to take court action against you , effectively only the landowner (peel) or their legally appointed agents (Excel) can take out a court action against you or initiate court action against you

    the creditor should be listed on your paperwork

    had you read the sticky threads you would already know this, but I have explained it for clarity

    it was also the same advice given to VMSmaven in his thread too

    for the last 9 months or so the people on this forum have not advised anyone to ignore these in england and wales

    It never fails to amaze me that so many people come on here for advice and then decide to completely ignore it ....


    I guess they are just hoping for a quick easy fix.


    Little do they know that every time they pay one of these scams they directly help to keep these companies in business to possibly scam them again.


    More people need to show a bit more backbone!

    i have sent the land owners of the peel center a complaint about them, so see how they respond if not i shall read the LBCCC sticky and go from there and study the letter they sent me and see if they fail to comply with anything.

    ok so i got a response from the peel land owners and they forwarded my concerns to excel.

    and in response excel sent me this.


    Good Afternoon Mr xxxx,

    I have been asked to investigate and respond to the below enquiry sent directly to Peel Land & Property on the 8th December 2013.

    Before I respond to the comments you have made, I must advised that The Peel Centre Car Park in Stockport is a pay on entry Pay & Display car park. The Terms and Conditions of the Car Park require for a valid Pay & Display (P&D) Ticket to be purchased within 15 minutes of entering the car park, detailing the full vehicle registration mark (VRM) i.e. xxxxxxx. Management of this site is conducted via ANPR cameras that take photographs of vehicles entering and exiting the car park and work in conjunction with the Pay and Display machines in situ.

    On the February 2013, you entered the Peel Centre car park at 19:36pm, exiting at 20:09pm. As advised above, our signs are located at the entrance and again at regular intervals in and around the car park. These signs not only state that a Pay & Display ticket must be purchased within 15 minutes of entering the car park, they also confirm the Pay & Display operable hours of 6am - 9pm.

    With respect to your comments concerning harassment. I can advise that only one Parking Charge Notice has been generated. As you have failed to appeal or settle the Notice in full, our Notice to Keeper and Final Demand Notice were issued. As no further contact was made from here, the matter was referred to our Debt Recovery Agents. Excel Parking Services Ltd strongly denies any claim of harassment, furthermore, had you have appealed the Notice in line with the Appeals procedure detailed on the reverse of the Parking Charge Notice issued on the 19th February 2013, the charge would have been suspended at the applicable amount, whilst the Notice was under appeal.

    Having reviewed the comments you have made, and looking at the Notice which was issued, I am satisfied that this Notice has been issued in full accordance with the Terms and Conditions in place for Parking at the Peel Centre, Stockport. As such, I will not be canceling this PCN.

    so im not all to sure how to respond to that and fight back. i am well aware i should have bought a ticket in the first place. and appealed against the ticket. and responded to them. but with my stupidity i ignored them.
