Newlyns Debt Collectors Letter

Just had my first letter from Newlyns debt for a Parking Charge Invoice that I got back in March 2013. I don't want to give details for obvious reasons. I've had the Graham White letters and all the rest of the guff and just ignored (which I have kept all apart from the first letter).
What is the probability of Newlyns taking me to court? I've only had one letter and just wondering if its worth going down the paper trail option or just edging my bets and leaving it. How many people have actually been taken to court and prosecuted by Newlyns?

Well zero, obviously, as private companies can't proscecute. There was no crime.
Not only are they acting merely as a debt collector but there was no credit agreement or default on any actual 'debt' and only a solicitor or the PPC themselves could try a small claim over an alleged debt like a fake PCN. Newlyn Debt collection are not the same set up as Newlyn bailiffs so please don't randomly search the name 'Newlyn' online and scare yourself by reading irrelevant stuff about the bailiffs of the same name, who act for Councils and after court cases (completely different than a debt collector = pen-pusher).
Why don't you check your Notice to Keeper (if you kept it - the first letter from the PPC in the post that told the keeper about the charge) against the POFA 2012? It's linked in the thread that bod1467 mentions which was at the top of the forum calling for newbies to read it first!
My sticky thread has the POFA 2012 linked and what to do about a debt collector pile of junk letters, and how to report a flawed Notice to Keeper to the BPA.
Everything you need is there - have a read. Unless you want to carry on ignoring this scam now, seeing as (if you are in England/Wales) you made the mistake of not taking it to POPLA at the time. Most PPCs do not try small claims but if you got actual court papers from the PPC (not Newlyn of course!!) it's defendable.
Finally what happened when you complained to the landowner about this harassment? Never too late, especially if it was a customer/retail car park.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks both for the advice I came home to my wife having kittens having typed in Newlyn and then reading stuff on this forum regarding the Newlyn Bailiffs who collect for the council. She was threatening to leave me if any baliffs came around :eek:
Unfortunately I don't have the very first letter from the parking company who are trying to fleece me of my hard earned. But I am judging by the response that I can just carry on ignoring and they will hopefully get bored and move on to some other poor sap. Can you either of you confirm that if in the unlikely event of this ending up in small claims court that this will not go on my credit file. In the even unlikely event of me losing that said court case that I would have this on my credit file.0 -
I can confirm that you DO NOT get any CCJ (not even a satisfied one) if you lose a small claim and then pay straight away after the judgment. There is no black mark, the judgment doesn't go on the register as long as the person pays when the judge directs. No 'CCJ' at all remains, nothing. Even if you lose you don't even get a slapped wrist - as 'nigelbb' on here once said, you don't even have to sit on the naughty step!

You don't have to ignore this, but making an informed decision about whether you can, partly depends on if yours is a litigious PPC or not.

Thanks Coupon my only concern is that I've had the letters from Roxborurghe Debt collectors on the cheap paper followed by the the infamous Graham White Solicitors/ Michael Sobell cheap threats. Am I right in thinking that this is the last throw of the dice or is there more to come?
The way I see its been 8 months since the alleged offence and you'd have thought that they'd have taken tried to take someone to court by now. Myself being the registered keeper of the vehicle keep getting these letters.0 -
Well Graham White letters are now not sent at all so you might get a nice repeat threatogram from me old mate from Worthing, Steve Dargonne at Roxburghe, with a bargain (NOT!) reduced charge offer! If so then send him a Christmas card and suggest Roxburghe donate the money they are wasting on writing to you, to the DEC Appeal. Had a call from them at my workplace recently and I am not happy about this to say the least. They managed to get me to confirm my name and address and that’s about it (caught me very off guard unfortunately). I asked them to confirm where they had got my name from and kept being put on hold and not giving me an answer.
I then asked for the persons full name and they refused to give it to me tried saying they weren’t obliged to. I repeatedly asked for their full name and would not supply it. I then told them that they had no right to ring me at my workplace due to an alleged parking invoice debt that I knew nothing about. Is this a new tactic being used by them ? I am guessing that they’ve been searching social media websites to find me. Finally can I report them to them to the police for harassment?0 -
No that's not harrassment, it's a common tactic amongst the dca's for normal debtsProud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0

Its not harassment but ringing your place of work is against OFT guidelines on debt collection, even alleged debt collection.

I lambasted the person who contacted who refused to give there full name and tried to spin me some yarn why they couldn't give it to me.
They have alleged that I have been instructed on behalf of xxxxx parking that I owe them and that they on the verge of taking legal action. My question is for if I report them to the OFT will this make them go away or just stir up more trouble? I am quite happy to sit this one out but I am not happy about people at work its as you say against OFT rules.:mad:0
